1 ?, 2 <br />Dr.,Suit said he does not know of any other streets that are dedicated and <br />accepted for public use and public maintenance. It seems Beech Hill is <br />being singled out as public maintenance to be assessed. <br />Mr. Feneli said other streets in the municipality have been.assessed. <br />Mr. Bob Fetzer, 899 Beech Hill Road - said the Village has accepted this road <br />for public maintenance by maintaining it over the years. However, the Village <br />has the prerogative to pave Beech Hill and assess the abutting property owners. <br />He questioned how Viacom cable could be put in on their street if it is not <br />accepted for maintenance. <br />Mr. Feneli explained whether or not the road was accepted would not apply . <br />because the cable is in the right of way. <br />Mr. Hovancsek said the general life of a pavement in a municipality is regaxded <br />to be 20 years. During that 20 year period normal maintenance of a street <br />accepted by the municipality is generally taken care of as a general maintenance <br />situation paid for by the Village. However, after a period of 20 years, should <br />the street need repairs, the municipality has the right to assess for repavement. <br />Mr. Stan Cotman, 917 Beech Hill Road - said for a number of years they were told <br />the street was not dedicated and accepted until someone took the time to look <br />through the records to f ind it was dedicated and_accepted. There has been a <br />lack of maintenance since Mr. Weiland died. He said the road got so bad it was <br />a hazard to safety and at one time they were told if they did not do anything <br />about it, fire and police protection would be cancelled: He re.quested a letter <br />noting this so they could inform their insurance companies but never received such <br />a letter. They are all aware their street wi11 be paved whether they want it or <br />not. Most do want it paved, they want it maintained as it is. He questioned <br />if Council decides to persist, when they are going to pave it. The last plan he <br />saw for paving had a four foot culvert on each side with stone and questioned the <br />need for that, as it would add to the cost. <br />Mr. Hovancsek explained that the best way to construct a steep slope V ditch is <br />using stone. This will save as many trees as possible and the ditch will function <br />properly and be maintainable. <br />Mr. Cotman said there are roads in the Village with steeper grades than Beech <br />Hill. The basic problem is they have not had any maintenance. The ditch has <br />functioned well for 20 years and he feels it should be good for another 20 years.. <br />Mr. Robert Fetzer, 899 Beech Hill Road - said apparantly Council plans to proceed <br />with the Beech Hill paving project and assess the property owners. The County <br />owns over ten acres of land on this section of Beech Hill where a large sewerage <br />storage and treatment facility is located. The paving would primarily benef it <br />the County, not the individual prope.rty owners. He read a section of an opinion <br />issued by the Attorney General Mark McElroy in 1962 (copy attached to these <br />minutes). He suggested Council investigate the possibility of asking the County <br />to come up with a good road surface for Beech Hill as the cost may be less. <br /> <br /> <br />d
