<br />Ordinance 81-59 (Handicapped Parking) <br />Council President Spellman stated that there have been some problems <br />to this ordinance and Chief Stevens has been voiding all tickets given;. <br />and police personnel have.been instructed not to issue anymore tickets <br />until certain problems have been resolved. He said Mr. Carmen was <br />checking into the matter and asked him to explain his findings. <br />Mr. Carmen stated he found.that the parking requirements as in this <br />ordinance can be retroactive, that existing businesses are required to <br />comply. He said he also found that tickets can be given on private <br />property. <br />Mr. Feneli stated at the time he prepared.the ordinance his research also <br />proved Mr. Carmens findings regarding private property correct. He said, <br />however, he does not still have his research on this. Per Chief Stevens <br />request he will.put this research together again so the merchants can be <br />advised they have to comply with this ordinance. <br />Mr. Carmen stated he felt the ordinance is not clear pertaining to the <br />"commercial establishments" that must comply. He said we meant the businesses <br />the public was invited to with more than 50 parking spaces, which would not <br />include office buildings. Mr. Etzler asked if Mr. Carmen was referring specifically to retail business. <br />Council agreed the Holiday Inn should be required to conform to this ordinance. <br />Discussion was held regarding the people who are handicapped but do not have <br />handicapped license plates. <br />Mrs. Bloom suggested something that could be placed in the car window only <br />while the person was parked in the handicapped space to show they are <br />handicapped, and to mention this in the ordinance. <br />Mr. Feneli stated the State of Ohio was working on an identification card <br />for handicapped persons that would be similar to Mrs. Blooms suggestion. <br />However nothing has yet taken placeo He said if we were to print our own <br />it would not solve the problem of others out of the community who did not <br />know they were available. <br />Mr. Feneli to redraft the ordinance to specify it is for retail businesses. <br />Sale of Cigarettes to Minors <br />Council President Spellman stated that Council has received a copy of a <br />letter pertaining to the sale of cigarettes to minors, asking Mr. Feneli <br />to explain the situation to Council. <br />
