J d <br />Mayor Beebe stated he would 1.ike to refer to Mr. Carmen regarding the <br />next portion which may involve him. <br />Mr. Carmen stated that four Council members have two pieces of legislation <br />to present to Council. The legislation was passed out. Mr. Carmen stated <br />over the last week he has received many phone calls, which ran 7 or 8 to <br />one in favor of the Mayor remaining in his position. He said that <br />basically, people feel Mayor Beebe was elected for a four year term, until <br />1983, and that he should stay on and do that job. Mr. Carmen said he feels <br />the majority of Council agrees with that. For that reason Councilman <br />Busa, Councilwoman Bloom, Councilman Etzler and Councilman Carmen had <br />instructed the Law Director to prepare a resolution requesting Mayor Beebe <br />f inish his term. <br />Mr. Carmen stated the four Council members also recognized the problems <br />between the President of Council and the Mayor in terms of what powers <br />belong to whom. He feels neither one has the ability, individually,-to. <br />determine where one power begins and the othe.r power ends. He feels some <br />type of impartial group is needed to help in those decisions. For that <br />reason the Law Director prepared an ordinance to restrict the authority <br />of the President of Council, establishing a procedure to resolve disputes <br />between the President of Council and the Mayor as to the division of duties <br />and authorities. He explained the ordinance states in the future when a <br />prablem occurs between the Mayor and the President of Council, with the <br />advice of the Law Director that dispute will come before Council as a Whole <br />and Council as a Whole will advise who has the power. Mr. Carmen asked <br />for Councils consideration of these pieces of legislation, recommending <br />passage of both. <br />Resolution 82-31, entitled; "A RESOLUTION UR.GING MAYOR ROBERT G. BEEBE <br />TO RESCIND HIS RESIGNATION AND TO SERVE OUT HIS ELECTED TERM OF OFFICE." <br />Introduced by Councilpersons Bloom, Busa, Carmen and Etzler. <br />Mayor Beebe read the resolution. <br />Council President Spellman asked if there was any discussion regarding <br />this resolution. <br />Mr. Flynn asked if Mayor Beebe had any comments. <br />Mayor Beebe had no comment. <br />Council President Spellman stated he would like this resolution to be <br />changed to be Introduced by Council as a Whole. <br />Mr. Carmen stated he objected to the change as the four Council people <br />listed asked that this resolution be drafted, not Council as a Whole. ' <br />Mr. Feneli explained that the change could be made if a motion is passed <br />to amend the resolution to read "Council as a Whole".
