1 - (': <br /> <br /> <br />Council President Spellman asked.Mr. Feneli if this ordinance usurps the <br />power of the Charter or the Codified Ordinances. <br />Mr. Feneli stated it does.not. He explained the ordinance established <br />a procedure, which may never have to be used. <br />Mr. Flynn withdrew his request that the ordinance be referred to Committee. <br />Mr. Busa stated he felt the ordinance should be acted on tonight and asked Mr. Avery why he felt the ordinance should.be discussed in Committee. <br />Mr. Avery said there shoulcl be an understanding between the Cbuncil President <br />and the Mayor as to whose authority is what but he does not feel anything <br />would be accomplished by the passage of this ordinance. <br />Mr. Carmen stated in all due respect to Mr. Avery, he would like the record <br />to show that Mr. Avery is acting as an advisor for Mr. Spellman in this <br />matter. <br />Mr. Avery stated he had.telephoned Mayor Beebe encouraging him to remain <br />as Mayor, as he was elected by the people. Council President Spellman <br />was elected by Council and should be supported by Council. <br />Council President Spellma.n stated he would like this ordinance also to be <br />Introduced by Council as a Who1e if there are no objections. <br />There were no objections. <br />Council President Spellman stated he is in support of the ordinance as he <br />would like to see the town move ahead. _ <br />Mr. Feneli stated, for the record, he hopes no one feels that he has chosen <br />sides in this particular dispute since he drafted the legislation as directed. <br />Mr. Carmen stated the record should show that Mr. Feneli had to draft this <br />ordinance as it was a directive from the four members of Council. <br />Roll Call: AYES: All <br />NAYS: None <br />Motion Carried. <br />Ordinance Passed <br />Mayor Beebe stated he understands why this ordinance was prepared and feels <br />disputes will be resolved, possibly without the need to use the ordinance. <br />He said this ordinance may be of assist to future Mayors and Councils. <br />Mayor Beebe stated, regarding Resolution 82=31, the number of phone calls <br />and visitors he had in the past week or so was beyond belief and very <br />gratifying. He said he was sure Council President Spellman also received <br />calls. He stated he has now had time to dwell on the rash statement he
