.?i tI <br />Council President Spellman stated that Rules of Order, 121.07, questions <br />the Parliamentary procedure not covered by or included in this Chapter <br />shall be determined by the Presiding.Officer in accordance with Robert's <br />Rules of Order, unless otherwise provided by.the Ohio Revised Code or <br />ordinances or Resolutions of the Village. He said, since the.Charter <br />amendment is not definitive he asks that the Law Director prepare in <br />writing how-.specificalJ.y,what that Section reads and to come back to us <br />next Monday. <br />Council President Spellman stated when a motion.and second.are made, <br />parliamentary-wise, the Chair has the prerogative to refer it'to Committee. <br />Mr. Feneli stated in order to supercede the motion made, a motion is needed <br />to table the subject. <br />Council President Spellman, seconded by Mrs. Hanus, made a motion to table <br />the subject of Finance Director until May 24. <br />Roll Call: AYES: Mrs. Hanus, Mr. Spellman <br />NAYS: Mrs. Bloom, Mr. Carmen, Mr. Etzler , Motion Failed <br />Council President Spellman stated he is referring the subject to the Committee <br />of the Whole next Monday. <br />Mr. Feneli and Mr. Carmen said that could not be done. <br />Council President Spellma.n asked the Law Director to quote the law telling <br />him that cannot be.done. ' <br />Mr. Feneli said once there is a motion and a second, unless there is a <br />successful motion to table the sub'ject, there has to be a vote. <br />Council President Spellman stated, "you obviously have your way on this <br />issue. I think it will be put into court but that's your decision. You <br />Gentlemen and Ladies, have made that decision." <br />Council President Spellman asked if there was any further discussion. <br />There was none. <br />Council President Spellman stated the vote is on the confirmation of the <br />Mayor's appointment of Steven Toth as Finance Director. Due to the fact <br />of 81-39 that was placed on the ballot, he said he finds it will be incorrect. <br />Roll Call: AYES: Mrs. Bloom, Mr. Carmen, Mr. Etzler <br />NAYS: Mrs. Hanus, Mr. Spellman Motion Failed <br />Appointment Not Confirmed <br />Council President Spellman stated, according to the Chair, he seriously thinks <br />there is going to be difficulties.
