A i <br /> <br /> <br />11 Roll Call: AYES: All <br />Council reconvened at 10:02 p.m. <br />Resolution 82-22, entitled; "A RESOLUTION AUTHORIZING THE RETENTION OF THE <br />PORTLAND CEMENT ASSOCIATION AS AN EXPERT WITNESS IN PENDING LITIGATION AND <br />DECLARING AN EMERGENCY." Introduced by the Mayor and Counci.l as a Whole. <br />Council President.Spellman stated this Resolution is on third reading and <br />Council has received an amended copy. <br />Mrs. Bloom asked if the only amendment was to the amount. <br />Council President Spellman verif ied that was the only amendment to the Resolution. <br />Council President Spellman, seconded by Mr. Busa, made a motion to suspend the <br />rules of Council requiring a resolution to be read on three separate occasions. <br />Council President Spellman asked if there were any comments for d_iscussion. <br />There were none. <br />Roll Call: AYES: Al_1 <br />NAYS: None <br />Motion Carried <br />Rules Suspended <br />Mr. Busa, seconded by Mr. Carmen, made a motion to adopt Resolution 82-22, as <br />amended. <br />Council President Spellman asked if there was any discussion. <br />Mr. Etzler commented he recalled that Mr. Avery had said that $1,000.00 would <br />cover the expert witness fee. This figure has.been changed from $1,000.00 <br />to $2,500.00 to $5,000.00 and back to $2,500.00 and he does not understand this. <br />Mr. Feneli said this was discussed in Executive Session and everyone has a <br />different recollection as to the amount. There are no minutes to refer to: <br />He stated this resolution is the current proposal. ' <br />Mr. Busa stated that the resolution mentions other things that must be done <br />in addition to expert witness testimony. The resolution.stipulates. the amount <br />of $2,500.00 shall not be exceeded, but does not mean it will be that amount. <br />Mr. Hovancsek explai:ned if additional test cores are going to be pulled out of <br />Wildwood Trail to be shipped to the Portland Cement Company, the cost would <br />be close to $3,000 with no expert testimony. <br />Mr. Carmen stated he would ask.that when we receive a bill that it be itemized- <br />justifying what it is for. <br /> <br />NAYS: None <br />Motion Carried <br />Resolution Adopted <br />(as amended)
