<br />MINUTES OF A SPECIAL MEETING OF COUNCIL <br />Village of Mayf ield ' <br />October 7, 1982 <br />The Council of the Village of Mayfield met in Special Session on Thursday, <br />October 7, 1982 at 9:00 p.m. at the Village Hall. Acting Mayor, Michael <br />W. Spellman, presided. <br />Roll Call: Present: Messrs., Busa, Carmen, F1ynn, Spellman, Mrs. Hanus <br />Absent : Mrs. Bloom, Mr. Etzler <br />Also Present Were . Mr. Amendola, Chief Stevens, Mrs. Maynard, <br />Mr. Feneli - (arrived at 9:20) <br />The Pledge of Allegiance to the Flag was given. <br />Council President Spellma.n stated the purpose of this meeting was specifically <br />to notify Council the Mayor is not in the municipality at this time. He is in <br />Lake Wales Florida. A sticky situation exists because there is nothing that <br />covers his area of authority. The Charter specifically states that when the <br />Mayor is absent from the municipality the President of Council is the Acting <br />Mayor. Mr. Spellman said he is being deprived of his position as Acting Mayor <br />to fulf ill his responsibilities as such. He stated he wi11 not be held <br />responsible for anything that should happen in this Village because the Ma.yor <br />has directed all employees and staff inembers that he will run the Village Hall <br />and the community from Florida. He is the Mayor, of course, and that is under- <br />stood. He has the prerogative to be kept in touch with the municipality of <br />matters that take place. However, when the Acting Mayor is not informed of <br />serious situations he cannot act upon those situations. In the event of ari <br />emergency the question arises whose authority is first - the Mayor who is not <br />in the state or the Acting Mayor who is in the community at the time of the <br />,crisis? No crisis exists now, no serious situation, no problems. He is <br />questioning a gray area in the Charter. Article IV, Section 7 states; "When <br />the Mayor is absent from the municipality, or for any reason is unable to <br />perform his duties as Mayor, the President of Council shall become the Acting <br />Mayor.',' The Law Department differs with this. The Mayor is willing to concede <br />to some degree, but when the tools of the off ice.cannot be used and Villagers <br />call with problems that must be relayed to Lake Wales Florida and responded to, <br />by phone, something is wrong. Mr. 5pellman said he would like to wait for the <br />arrival of the Law Director a little while longer. Mr. Feneli has been in <br />touch with the Mayor who left Tuesday afternoon, and Mr. Spellman would like <br />him to present his side of the story. ' <br />Ordinance 82-84, entitled; "AN EMERGENCY ORDINANCE AMENDING SECTION 123.02 OF <br />THE CODIFIED ORDINANCES." Introduced by Council as a Whole.
