If it should be <br />a policy matter the Mayor must make that decision. <br />Residents complained their taxdollars were being spent on long distance calls. • <br />Mr. Feneli said.that is a permissible expenditure, cleared through.the State <br />Auditors Office. If the Mayor.had to fly home for an emergency it could be <br />billed to the taxpayers. However, the Mayor has indicated to him he would do <br />so at his own expense, If anyone has further questions he will give them the <br />number of the attorney for the State Auditors Office. <br />Council President Spellman said.the laws_are written vague and can be inter.preted <br />many wayso. There are no laws specifying who opens mail, etc. He thinks a <br />particular situation did arise and because of what has taken place-over the past <br />months the interpretation of the law, therefore, is directed in this particular <br />fashion. Council President Spellman stated he does not take claim to the <br />Mayor's Off ice and he does not want to use the off ice. He wants to be informed <br />of what is going on in the Village or he is not.re.sponsible. He said the letter <br />the Mayor wrote indicates Mayor Beebe is responsible and he thinks that is very <br />clear and there is no need to go on with this shenanigan because that is what it <br />is and it is degrading and ridiculous. <br />Mr..Carmen recalled the ordinance 82-32 passed by unanimous vote of Council, <br />that in the event there were.problems regarding the_interpretation of where the <br />Mayor's authority begins and the Co.uncil Presidents beg.ins, it was to be referred <br />to Council to determine. Mr. Carmen suggested if Mr. Spellman runs into a <br />problem where he thinks he has the authority to do something and he isn't.given <br />access to information or being allowed to do what he intends to do, he should <br />bring it before Council. .. <br />Council President Spellma.n said he ha-s no speeific situation.but just wanted <br />clarification so he brought the matter before Council. <br />Mr. Busa said he holds Council President Spellman.totally responsible for the <br />health and welfare of this community and with that.resporisibility he has the <br />full authority to function that way. if something goes wrong in the absence of <br />the Mayor he will not blame the Mayor, he will blame Council President Spellman. <br />Council President Spellman must have total authority and access and,must assume <br />direct responsibility completely without question .o.r doubt. He feels it is <br />unfortunate this type of situation exists, where somebody says one cannot sit <br />in a certain place. Wherever Mr..Spellman sits he is .responsible and should <br />enjoy the full autfiority from Council and the people to function and perform. <br />Mr. Feneli suggested Council get to the bottom line of the meeting, following <br />the script Mr. Spellman told him was going to be followed. He said Mr. <br />Spellman had told him he would deny any responsibility then a member of Council <br />would say the responsibility was Mr. Spellma.ns and then a vote would be taken. <br />He suggested Council vote to conclude this. Council President Spellman said he did not orchestrate this. He will claim <br />responsibility after_passage of this memo. He asked for a roll call vote <br />for the memo.
