?.?o <br />Mr. Feneli said the Mayor said the Acting Mayor may not use his office but <br />he could sign checks, see the mail and.the number one priority is to keep <br />the residents happy.. As far as administrative and policy decisions, Mayor <br />Beebe is the Mayor and will continue to run the Departments.' , <br />Mrs. Hanus said the Ma.yor's letter to Mr. Spellman states; "The Department <br />Heads and Donna are quite capable and really do not need any directives <br />other than those I as Mayor issue from down here." According to that it <br />does not seem to her that Mr. Spellman would be the Acting Ma.yor, which she <br />feels is wrong acc.ording to the Charter. <br />Mr. Feneli said it is customary in Cuyahoga County when a Mayor is out of <br />town that the Acting Mayor signs things that cannot wait for the Mayor to <br />return and f ills in ceremonially. The Acting Mayor does not issue directives <br />to Department.Heads or overturn policy-that is already there. The Mayor that <br />returns must face an administrative situation that he created before he left. <br />Most Council Presidents say they will be there if an emergency arises but <br />they would not use the Mayor's Office. He has researched this in many <br />communities. Mr. Feneli said he thought everything was settled after his <br />phone conversation with Mr. Spellman, <br />A resident stated the Charter is the governing body of this community and <br />asked if Mr. Feneli's statersents were from the Charter. <br />Mr. Feneli said it is from his interpretation of the Charter, that no Charter <br />covers every situation. Our charter is interpreted by the State of Ohio. As <br />Law Director he can only refer to cases involving Charters with similar, <br />wording. <br />Mr. Carmen said if a crisis arises we.expect Council Pres'ident Spellman to <br />take care of it. He is expected to respond to important mail that requires <br />immediate action and to residents with complaints. He does not expect him <br />to make new policies. . <br />Council President Spellman stated it is not his intention to ma.ke new policieso <br />The problem is you do not get any phone messages and if a.problem arises who <br />is to be held responsible?, <br />Mr. Feneli.said in a crisis everyone agrees Mr. Spellma.n takes over. An <br />Acting Mayor should not take over, make policy decisions or.counterma.nd. <br />orders already in existence.. <br />Council President Spellman said that is not what he is intending to do. <br />Mr. Feneli and Mr. Carmen asked him what the problem was. <br />Council President Spellman stated that in a crisis or any type of situation <br />he wants access to information. He asked if it is right that the Department <br />Heads phone Florida first for minor situations that may occur.
