E ? e MINUTES OF A BOARD OF APPEALS MEETING Village of Ma.yf ield December 20, 1982 The Council of the Village of Ma.yfield met as a,Board of Appeals on Monday, December 20, 1982 at 8:08 p.m. in the Village Hall. Council President, Michael W. Spellman, presided. . Roll Call: Present: Messrs., Busa, Carmen, Etzler, Flynn, Spellman, and Mrs. Hanus Absent : Mrs. Bloom Also Present Were . Mayor Beebe, Messrs., Amendola, Feneli, Toth, Mrs. Ruggles, Chief Stevens, Sgt. Schutt, and Mr. Hovancsek (arrived at 8:15 p.m.) Council President Spellman stated this meeting is being held because Mr. Paris has a presentation to make following the decision made by the Planning and Zoning Commission. Mr. Feneli explained Mr. Paris, through his son Zachary Paris who is also an attorney at law, requested to be placed on the agenda for the purpose of presenting to Council the same proposal that was made to the Planning and Zoning Commissic;ii for a modif ication of the existing parking variance on the Beta Off ice Complex. He said Mr. Paris is being represented by Mr. Bartunek. He said this meeting/is bein.g taped by the Council Clerk, a routine procedure for ease in preparing Council minutes, He said he wants Council to consider several things when listening to Mr. Paris' testimony.. They should consider only the presentation made tonight. The request must stand on its own merits. Any other previous variance requests made by Mr. Paris, or any past experience should not be considered. Council should detertnine if the request for a doctor's office in the Beta Off ice Complex falls within proper zoning. If it is permitted in that zoning district, then Council must allow it. Council must look at how much parking is available at the Beta Off ice Complex, and base their decision on that, only. Mr. Joe Bartunek, 950 Bond Court Building, was present to represent Mr. Paris. He introduced the people present, some of whom would be used as witnesses later during the meeting. He noted a Court-Recorder.was present. Mr. Bartunek stated in March 1979a parking variance for the Paris off ice building on Beta Drive was granted. The variance permitted one parking space for each 200 gross square feet with certain conditions. One of the conditions was that no occupancy for medical or dental offices would be permitted that could not be built without this variance. He said, they believe under the existing code of one space per 75 square feet for a medical building they would qualify. He said, if Council believes that it should be permitted under the law it must
