E ? e <br />MINUTES OF A BOARD OF APPEALS MEETING <br />Village of Ma.yf ield <br />December 20, 1982 <br />The Council of the Village of Ma.yfield met as a,Board of Appeals on Monday, <br />December 20, 1982 at 8:08 p.m. in the Village Hall. Council President, <br />Michael W. Spellman, presided. . <br />Roll Call: Present: Messrs., Busa, Carmen, Etzler, Flynn, Spellman, and <br />Mrs. Hanus <br />Absent : Mrs. Bloom <br />Also Present Were . Mayor Beebe, Messrs., Amendola, Feneli, Toth, Mrs. <br />Ruggles, Chief Stevens, Sgt. Schutt, and Mr. <br />Hovancsek (arrived at 8:15 p.m.) <br />Council President Spellman stated this meeting is being held because Mr. <br />Paris has a presentation to make following the decision made by the Planning <br />and Zoning Commission. <br />Mr. Feneli explained Mr. Paris, through his son Zachary Paris who is also an <br />attorney at law, requested to be placed on the agenda for the purpose of <br />presenting to Council the same proposal that was made to the Planning and <br />Zoning Commissic;ii for a modif ication of the existing parking variance on the <br />Beta Off ice Complex. He said Mr. Paris is being represented by Mr. Bartunek. <br />He said this meeting/is bein.g taped by the Council Clerk, a routine procedure <br />for ease in preparing Council minutes, He said he wants Council to consider <br />several things when listening to Mr. Paris' testimony.. They should consider <br />only the presentation made tonight. The request must stand on its own <br />merits. Any other previous variance requests made by Mr. Paris, or any past <br />experience should not be considered. Council should detertnine if the request <br />for a doctor's office in the Beta Off ice Complex falls within proper zoning. <br />If it is permitted in that zoning district, then Council must allow it. Council <br />must look at how much parking is available at the Beta Off ice Complex, and base <br />their decision on that, only. <br />Mr. Joe Bartunek, 950 Bond Court Building, was present to represent Mr. Paris. <br />He introduced the people present, some of whom would be used as witnesses <br />later during the meeting. He noted a Court-Recorder.was present. Mr. Bartunek <br />stated in March 1979a parking variance for the Paris off ice building on Beta <br />Drive was granted. The variance permitted one parking space for each 200 gross <br />square feet with certain conditions. One of the conditions was that no <br />occupancy for medical or dental offices would be permitted that could not be <br />built without this variance. He said, they believe under the existing code <br />of one space per 75 square feet for a medical building they would qualify.
