?? <br />Regular Council Meeting <br />4/18/88 <br />Page 9 <br />Mayor Carmen said he recalled saying that but his conception was that the <br />concern was not with the existing driveway because they have lived with the <br />the way it was. He felt the concern was with the new portion of the <br />driveway because it was swinging out closer to the homes, and that they <br />wanted additional landscaping on that portion of the driveway where it is <br />very close to the homes. He did not understand that a request had been made <br />to mound and put additional trees in all the way down including the existing <br />portion of the driveway. <br />Jeanne Leppla asked if Mayfield Village has an ordinance to protect the <br />residential property from the traffic and the noise when a commercial <br />property abuts a residential propertys <br />Mayor Carmen explained that normally commercial and residential areas are <br />not next to each other, they are in a confined area. There is not a generic <br />ordinance that stipulates that you must protect every residential area from <br />traffic. <br />Jeanne Leppla said that they have a little problem with their good faith <br />because in good faith they were going to have the houses up for sale, keep <br />up the property, and we are running out of their good faith. She said that <br />once this driveway is approved, we're out in the cold. <br />A woman in the audience said that every few months we have been having <br />a meeting and voting on plans that Progressive submits. We come back and <br />they say Progressive changed their plans, so our vote goes out the window. <br />She said that it's hard for her to believe that you did not know that buffer <br />zone wasall along the 90' buffer because she does not even live on Worton <br />Park and she thinks these people should have protection. She said that they <br />can't keep coming and voting every time Progressive changes their plans. <br />Mr. Feneli said that he recalls that there were to be two separate sets of <br />agreements. He said that if he would have known these people were going to <br />be present this evening he would have brought his Progressive file. He has <br />drafted a second separate agreement which was to be executed by Progressive, <br />you and us again if, as, and when this addition came to be. That was <br />dealing with a buffer or a mounding concept. He said that agreement on the <br />screening of the existing driveway was going to remain as it is now until <br />they built this addition. He said when you are saying there is nothing to <br />force them to do this at a future time, he thinks you are looking at seven <br />people and a Mayor that have that power to do thato <br />Discussion was held. <br />Mayor Carmen reviewed and read from correspondence in his files pertaining <br />to the relocation of the drive and from the Village Engineer about mounding. <br />Mayor Carmen said he felt the agreement has been held up and held up because <br />they are afraid they will never again have a chance to get those things <br />which they think are important to them. He said that the Wilson Mills Road <br />construction has begun. To be sensible and to create less inconvenience, <br />this construction project has to be tied into that construction project. He <br />said the final document says Progressive agrees when pursuing the expansion <br />of its facility to provide sufficient lanclscaping to achieve a natural <br />barrier whicH will serde as an effective visual and audio screen between the <br />two zoning uses.
