He said he had never contemplated that they would <br />have to do it along the existing portion of the driveway because it was his <br />understanding that there was already existing screenage there. He said he <br />does not recall anyone saying Progressive has to rip out a driveway to <br />satisfy this contract. <br />Mr. Leppla said they specifically asked that point at one of the meetings. <br />He played a portion of the tape where Mayor Carmen spoke. On the tape, <br />Mayor Carmen said the only issue that remains is what we are getting in <br />return for ito On the tape he said that he thinks we have gotten everything <br />we wanted from Progressive save f or perhaps the mounding. Someone else on <br />the tape commented that they were looking for a little more screeningo <br />On the tape, Mayor Carmen said that he thinks that's a whole other issue. <br />Discussion was held about mounding. <br />Mayor Carmen said that it was his understanding when they talked about <br />mounding and trees that it was for a screen for the residents along the new <br />portion of the road that goes back and hooks up to the existing road. He <br />said that we had talked about mounding in addition to that when Progressive <br />had proposed a plan for a much larger building. Mayor Carmen said that <br />that discussion was changed considerably when Progressive said they were <br />revising their plans again and were not planning that building, and all they <br />were going to do is put in the driveway and the small building. <br />Mr. Leppla submitted a petition to Council. He said that it was signed by <br />50-55 people who say that it will be enhanced along the entire 90' buffer <br />and with a letter from Jonathan Lewis stating that he is under the <br />understanding that it's along the 90' buffer. Mr. Leppla said that what <br />Mayor Carmen is saying is that everybody in this room and those that have <br />signed that petition have a bad memory. <br />Mr. Rinker explained that that was out of context because alot of <br />discussions were held specifically about the entire length because they had <br />a proposal for a 4-story building in f ront of them. <br />Mr. Rife stated that in February 1987 when Mr. Rinker was a co-chairman with <br />himself that one of the listings on the agenda for the agreement was that <br />there would be mounding or something along the 90' buffer. <br />Discussion was helda <br />Mr. Schiemann said the plans presented tonight do not show landscaping along <br />the 90' buffer zone that we intended would be there before they start <br />construction on the driveway. He said they had 10 days in the contract to <br />list the houses; they're not listed. <br />Jeanne Leppla said that on the tape Bob played earlier.there is a portion <br />where Mayor Carmen told Sam not to worry he would get his trees, he would <br />get his mounding. She said why would it not be then along the parking lot <br />because that is what Sam meant. She said that Sam is dealing with the noise <br />of the trucks and cars every day. He wants a buffer when that driveway goes <br />ino Mrs. Leppla said that he's concerned that when the road goes down to <br />the new building that Bob and I and all the other homes are going to have <br />the same problem. She said that when you approve the driveway we have <br />nothing left really to bargain with.
