68 <br />Regular Council Meeting <br />6/20/88 <br />Page 8 <br />Mayor, Carmen said that.they ha&talked about asking Progressive -to provide <br />additional. screening along the existing driveway toward the back where the <br />residents had-originally-thought there would be additional: screening. He <br />said he believed that Mr. Hovancsek had contacted them and they had said <br />that they would consider that request. He said that that was the last he <br />had heard. Mayor Carmen asked that Mr. Hovancsek contact them again and <br />ask them what the progress of.that is and.what they would be willing to do, <br />Aintree North Drainage - Mr. Ramos said that Mr. Feneli spoke with the <br />developer today.... They said they will go out to the.property if the city <br />would hold them harmless from trespass. Mr. Ramos said that we would need <br />legislation allowing. them. to act as:our agent in order to do the work. <br />However:, he.said there.is.a problem with one-property owner.. He said that <br />Mra. Feneli will try to.get that squared away...Mr. Ramos said there are <br />practical solutions that must be exploredv. . <br />Mayor Carmen said whatever is done he wants it done yesterday. He said as <br />far? as preparing legislation to go onto the property, that they haye told <br />the developer they will give them permission to work in the easement in the <br />right-of-way. He said they don't need a hold-harmless from the Village when <br />the property owners have given them a right-of-way to do the work on those <br />four properties. With respect to the two property owners ?that have not <br />given them the right of way,.one property owner was told that we would not <br />do any:work on their property and we would let.the natural flow of water cut <br />the ditch. Mayor Carmen said that they are attempting to work out an <br />arrangement with the. second property ownera If an agreement cannot be <br />reached he said.it should be taken by eminent domain to get the work done. <br />Split Parcel 831-9-3 - Mr. Ramos-said that he contacted both of the property <br />owners involved. He said they are willing to cooperate and will get in <br />touch with Mr...Amendola. They, hopef.ully, will be attending the next <br />Planning and Zoning meeting. He f eels that this can be resolved without <br />legal_tactics. I <br />Completion .of Community Room HVAC - Mr. Amendola said the air conditioning <br />system has been functioning properly f or about a week. He said. there is <br />still a problem with the heating system and does not feel the payment should <br />be released. <br />Mr0 Patrick said he will not make the final payment until Mr. Amendola <br />notifies hims <br />Fisher's Tavern - Mr. Ramos said everyone should have received a letter from <br />Mr. Feneli explaining that the judge vacated his order of approximately a <br />year ago. He said that when the issue is resolved in the Court of Appeals <br />they can revert back. Mr. Ramos said they are taking the necessary steps to <br />go.-to „ the,Court of Appeals and hope to have some type of decision in the <br />immediate futurea , <br />Highland Road Berms -:Mr. Hovancsek said that he spoke to Mr. Bliss at the <br />Cuyahoga Countgy Engineer's Office and he indicated they would be doing some <br />work on the bermso They have added asphalt to the existing p_avement.
