103 <br />MINUTES OF A SPECIAL MEETING OF COUNCIL <br />Mayfield Village <br />September 7, 1988 <br />The Council of Mayfield Village met in Special Session on Wednesday, <br />September 7, 1988,,at 8:00 p.m. in Council Chambers of the.Mayfield Village <br />Hall. Council President Santo Basile presided. <br />Roll Call:, Present:. Mr. Basile, Mrs. Cinco, Mr. Flynn, Mrs. Mills, <br />Mr. Rinker, and Mr. Santoro. <br />Absent : Mr. Petschauer <br />Also Present Were . Mr. Ramos and Mrs. Martin. <br />Mr. Basile stated the purpose of the meeting is to consider Ordinance 88-34. <br />He asked Mr. Ramos to explain the ordinance. <br />Mre Ramos gave a summary of the events.leading to the ruling made by <br />the Supreme Court against the City of Cleveland. The city held a public <br />meeting without proper notice to the public and the news media. In <br />addition, they refused them access to the meeting. Since the City of <br />Cleveland's Charter specifically states that:all meetings are to be open to <br />the public, they were in violation of their Charter. The Court did not <br />consider the Sunshine Law in this case. Because of this case, many <br />communities passed legislation to provide for holding executive sessions. <br />Mr. Rinker questioned the wording of the ordinancea <br />Mr. Ramos explained that an ordinance was put together so that immediate <br />action could be taken to meet the deadline to get it on the ballot in <br />November. Since this ordinance was drafted, he has had a chance to discuss <br />the matter with other municipal attorneys. Some communities have decided to <br />do nothing and after. reviewing the matter more thoroughly, it is his <br />recommendation the ordinance be placed in the minutes as a first reading; if <br />however, it is Council's wish.to pass the legislation,.the rules will need <br />to be suspended. If Council wishes, the ordinance can be tabled and no <br />action is required. • <br />Further discussion was held:and Mr. Ramos stated that the Village has been <br />holding their meetings correctly and are not in violation of the Supreme <br />Court - Plain Dealer Case. He feels it is premature to propose a charter <br />change at this time and until we know the direction the Court will be taking <br />regarding executive sessions, he is recommending no action be taken. <br />Mr. Rinker questioned if there has been any recent amendments to the <br />Sunshine Law. <br />Mr. _Ramos stated. that he has been checking as late as today and the <br />only expections that he is aware of - he,will check.again and let Council <br />know at the Caucus if there is any more - are those six exceptions to <br />holding an executive session as listed in our ordinances: To Eurchase Real <br />Estate; Personnel;, Bargaining Unit; litigation; Federal and State Law <br />Requirements and Special Security (riot's etc.). As long as we stay within <br />these guidelines, the Village will not be in violation to any laws.
