84 <br />inclusive of homes. He cited that any employee has the right to quit,.or <br />go elsewhere at an.y time for any or no reason, and that he has the same <br />right as an employer. He said he is not forcing anybody in his establish- <br />ment to tolerate smoke, if they don't like it they are certainly free to <br />leave. He has a policy that provides for employees to appeal and to agk <br />that their area be declared a"no smoking" area. He said Cinncinati-?has= <br />passed this ordinance but is now having problems with it and are considering <br />repealing their equivalent to o.ur Section E. He said Clevelan.d can't <br />pass this ordinance. It seems to make little or no sense to impact <br />businesses, he said, which he is sure will raise.easts,c,to this community. <br />If we believe each business in this communtiy is going to allow an outsider <br />into their building to inspect their premises for compliance to this <br />ordinance, that is absolutely being naive. It will be challenged, there <br />will be costs. He does not believe at this time that this Council of the <br />community wants to turn its business off or incur extra funds. He does not <br />believe that this ordinance is that important for Council to be addressing <br />right now. <br />Mr. Larry Pollak:;:: 6726 Wilson Mills Road - said he has talked to a number <br />of residents besides himsel.f, who favor this legislation.. One of the <br />things that was brought up by business (and he is not anti-business), was <br />that the businesses do not have to vaGe. He said that is part of the <br />legislative procedure, which he further,explained.. Secondly, regarding <br />the interfering with civil.rights by passing laws that protect the health <br />of people, whether they live in the Village or work in-the Village; he <br />feels.that it is their responsibili.ty to do so. He thinks the only point <br />we have to find out is: are people being harmed in Mayfield Village by <br />passive smoke. He thinks the answer is pretty evident. He sells <br />ultrasound equipment to the medical commun=;ty. The-doctors he calls on <br />are constantly saying that the fe:tuses?>can be damaged by a passive smoker. <br />He feels.the time to legislate is before something happens. Many people <br />are bothered by passive smok.e (due to allergies, asthma, contact lens <br />wearers.) He feels the question.is: are people being harmed in <br />Mayfield Village, and he believes the answer is yes. <br />Ms. Nancy Schroeder, Holiday Inn - said she feels there are particular <br />problems in a hotel that do not even apply to anything that has been <br />talked about this eveninge A vast majority of'their employees.smoke. <br />She explained if one person in a group of employees did not smoke, the <br />rest of them would have to move. In a hotel, that is an impossibility. <br />She said they have limited facilities for employees. She does not <br />know how it could be handled; or how it could be handled. There are alot <br />of other things in the ordinance to be addressed. <br />Dr. Stabile, Mayfield City Schools -_said he thinks the government should <br />take steps to make smoking less socially and legally acceptable. He <br />thinks the causes of smoking should be borne by the smokers, not by a <br />non-smokers. He said we have three schools in Mayfield Village. He does <br />not know all of the details of the ordinance, but they would be more than <br />happy to comply. <br />Ms. Juliet Reminic, American Cancer Society - Lakewood Resident - said she <br />does education with companies throughout the Cuyahoga County area, including <br />Mayfield Village. She said she received a call about a sign that was over
