125 <br />Mrs. Klang said she has still not received copies of who is on the Architectural <br />Review Board and she would like to know if they are supposed to view the area <br />before they permit this to go through. She asked for copies of the blueprints <br />and the permits. She is getting a copy of her deed restrictions because she <br />did not know she was notalTowed to hang clothes in her back yard. She <br />questioned what else might be included in the deed restrictions. <br />Mayor Carmen explained that the city does not have the r.ight to enforce the <br />deed restrictions. The deed restrictions are up to the individual property <br />owners to enforce. The Village enforces the Planning and Zoning and Building <br />CodF, the Charter, and the ordinances of Mayfield Village. Mayor Carmen said <br />he looked at the four:datior., of the garage prior to this meeting and agrees <br />that all requirements set by the Village have been met. <br />Mrs. Klang said she wants the property surveyed because they keep moving the <br />line. She asked why the work can't be stopped until it is surveyed. <br />Mayor Carmen asked Mr. Amendola to make sure that the area be surveyed again <br />to make sure that all requirements are met. <br />Mayor Carmen explained that in a large code such as ours, there are going to <br />be certain antiquated things that are not seen until problems arise. This is <br />one of those cases. Now that we know the problem exists, legislation wi11 be <br />enacted to prohibit it. . <br />Discussion was held. <br />Mrs. Klang asked why the Architectural Review Board approved the plans so <br />quickly. <br />Mr. Feneli.said :that when:the plans are within our code, they cannot hold up <br />on approving them. He.explained the function of the Architectural Review <br />Board which is to make sure the buildirg is in conformance wiCh the basic <br />architectural design of the home. Then,_the building commissioner reviews <br />the plans to make sure that the planning and zoning and building codes are <br />met. If any one requirement is not met then it must come to:?the Board of <br />Zoning Appeals. .In this case, it met the code in all areas. <br />Mrs. Klang commented that the value of the homes in the area will decrease <br />because of the warehouse (garage) being built. <br />Mrs. Klang asked what could be done if the property owner sells cars out of <br />his yard,. <br />Mayor Carmen explained that private property owners may sell a car on their <br />1ot if the title is in thei.r name. The garage may be, used for storage and <br />personal use. <br />Discussion was held. <br />Mayor Carmen said that checking the deed restrictions was a good thing for <br />the residents to do, but the municipality has nothing to do with:.the deed <br />restrictions, and the garage conforms to the Village`s present code. <br />There being no further business, the meeting adjourned at 10 p.m.
