He said <br />that since a doctors' office is being contemplated, a condirional variance might be <br />considered. The condition would be that there would be no evening hours at that particular <br />facility. He felt that might strike the balance. _ <br />Mr. Arnold Eisenberg said they are considering offices for two doctors. He noted the <br />number of examining rooms and labs that would be required. He said they would <br />conceivably use 14 parking spaces; or a rnaximum amount of 20 spaces. <br />Dr. Price, Vice President of the Corporation asked what time would constitute the "evening <br />hours." <br />Mayor Cannen said 6 p.m. <br />Mr. Basile said that if an additiona114 space variance was granted, (with the previous <br />variance granted) it would mean that a variance was needed for a total of 50 spaces. <br />Mr. Eisenberg stated that there are always about 80-100 empty parking spaces at the plaza <br />and that he did not feel it would cause a parking problem. <br />Mr. Rinker asked what precedent the Village would be setting if it granted the variance. <br />Mayor Carmen said that we have granted conditional variances before. The variance would <br />go with the doctors if they were to move out. <br />-•- -- - Mr. Ramos explained why a conditional variance is like a special use permit. It is granted <br />due to unique circumstances on a case-by-case basis. <br />Mr. Eisenberg said he has not had requests to lease the space from any retailers. He said <br />service oriented businesses have done well. The lease being considered by the doctors is a <br />5-year lease with option. <br />Mayor Carmen said the biggest reason why a variance is granted is if a hardship exists. He <br />said the center has been open 11/2 years which looks like a classic hardship case. He said <br />our goal is to balance the needs of businesses and try to treat them as fairly as possibly and <br />to try to meet the needs of the home owners. He feels where you can strike a balance, even <br />with the risk of setting a precedent, he feels you should try to do so. <br />Mr. Pietrafese asked what is being considered for the last spot and if they will run into <br />another problem when it is leased. <br />Mr. Musca said it embarrasses him to be here. He hopes not to come back and ask for <br />another variance. He said he is not asking for anything he feels is bad for the city. He <br />would like to fill his building. <br />
