- ?;-- <br />'a?1 <br />MINUTES OF THE REGULAR MEETING OF COUNCIL <br />Mayfield Village <br />April 17, 1989 <br />The Council of Mayfield Village met on April 17, 1989, at 8 p.m. in the <br />Council Chambers at the Mayfield Village Hall. Council President Santo <br />Basile presided. <br />Roll Call: Present: Mr. Basile, Mrs. Cinco, Mr. Flynn, Mrs. Mills, Mr. <br />Petschauer, and Mr. Rinker <br />Absent : Mr. Santoro <br />-, A1so,Present Were ., Mayor Carmen, Mr. Amendola, Mr. Patrick, Mr. Ramos, <br />Firefighter Neyman, Ptl. Dearden, Mr. Wolszynek for <br />Mr. Hovancsek, and Miss Heath. <br />The Plege of Allegiance to the Flag was given. <br />OPEN PORTION <br />Mr. Dennis Rash, 823 Beech Hill Road, said that there was another overflow <br />of the creek along Beech Hill Road over the weekerid. He said he would <br />like to congratulate the Village for at least thinking about having a <br />lawsuit against the Northeast Ohio Regional Sewer District. He said he <br />went to the site of the overflow,. Mr. Rash said that he disagrees with <br />the article that was in the Plain Dealer said that the overflow was "no <br />big deal". He asked if anyone had a written plan as to who calls who; if <br />there's a plan--he doesn't see it. <br />Mr. Amendola said that he called the sewer district and got no answser, <br />then he called their emergency number and got no answer. He finally <br />reached someone who told him they were waiting for someone to make a float <br />valve adjustment. <br />Mr. Flynn suggested we write a letter to Mr. Odeal asking for suggestions <br />and what they can do to prevent this from happening again. <br />Mayor Carmen said that the Village has written many letters to them about <br />this problem and that he did not feel writing another letter would help. <br />He said he had received four calls about the problem. He was advised that <br />there was a mechanical malfunction at the Beech Hill Pump Station. He <br />said that the crew on duty were not aware of or competent enough to handle <br />the situation. Mayor Carmen asked if we have grounds to get an injunction <br />against them. <br />Mr. Ramos said that an injunction was filed against the sewer district in <br />1980 and briefly described the preliminary injunction. <br />Mayor Carmen said that we want to stop them from spilling into the creek; <br />that it is unacceptable. He asked when Mr. Ramos thought it `would be <br />ready to go. <br />Mr. Ramos said by the end of the week.
