??? <br />Regular Council Meeting <br />7/17/89 <br />Page 5 <br />OLD BUSINESS <br />Aintree North Drainage - West End - Mr. Basile asked when they will be <br />completed. <br />Mr. Hovancsek said they will be completed in about ten days. <br />Mayor Carmen said the contract was awarded to C.I.R. in the amount of <br />$70,000 to do preliminary work. He said that because the bid came in <br />lower than expected we will look into doing more work. Mayor Carmen <br />said he met with Bob Bright of Burgess and Niple and a drawing will be <br />made up and we will see if we can do all the work this year. <br />Ditching North of Highland Road - Mr. Hovancsek said that he spoke to <br />Rusty Roseback of Forest City. They are anticipating cleaning the <br />ditch to S.O.M. Center Road and if they do that, they would consider <br />doing the work themselves. <br />Mr. Basile asked how soon Mr. Hovancsek expected an answer from them. <br />Mr. Amendola said the contractor had been in today and they looked over <br />the drawings. There is a question that the outlet of this water is <br />approximately one foot lower than the inlet on S.O.M. which would have <br />to be checked by the Village Engineer. <br />Mr. Hovancsek said he would check it this week. <br />Seeding of Berms - Mr. Hovancsek said he still hasn't been able to <br />contact Jim Bede. He will be doing work as a subcontractor for <br />Bonnieview Road so he will be in town within the next ten days. <br />Mr. Basile asked Mr. Hovancsek to make sure he completes the work on <br />the other roads. <br />Fisher's Tavern Injunction - Mr. Feneli said that the Village Council <br />should have received a letter from him detailing the results of the <br />pre-trial that was held on June -14. He said that it contains a <br />proposal for resolving the Fisher's Tavern issue short of any <br />preliminary injunction hearing or trial. Mr. Feneli said they are <br />willing to eliminate the four tables not to be further away from the <br />eastern wall than 10 feet and then everything else will be on the <br />north. Mr. Feneli said he is merely reporting their proposal, he is <br />not making a recommendation. <br />Mayor Carmen said he had received a call from Dr. Faulkner regarding <br />the same proposal. He said it is up to Council whether they want to <br />press on with litigation or want to settle it. <br />Mr. Basile asked the pleasure of Council. <br />Mr. Rinker said he would like to find out additional information <br />regarding the probability before he makes a determination.
