<br />Public Hearing <br />8/21/89 <br />Page 2 <br />Ordinance No. 89-25, entitled; "AN ORDINANCE REPEALING CODIFIED <br />ORDINANCE SECTION 1157.05 PERTAINING TO THE CREATION OF A DISTRICT <br />KNOWN AS U-3AA RESTRICTED MULTI-STORY APARTMENT HOUSE DISTRICT, AND <br />REPEALING ALL ORDINANCES INCONSISTENT HEREWITH." Introduced by Mayor <br />Carmen and the Entire Council. <br />Mr. Ramos said that several years ago the code was changed to U-3AA <br />which would allow high rise apartments up to 160'. He said that there <br />is no property in the Village that is zoned U-3AA; that it is not <br />possible according to our zoning map. Mr. Ramos said that to change <br />the zoning, any developer would have to go to the electorate and the <br />land would have to be rezoned. He explained that since we do not have <br />any property that is zoned U-3AA, we are proposing this issue which <br />would take reference to U-3AA zoning out of our code so as to take out <br />high rise apartments in Mayfield Village. <br />Ordinance No. 89-26, entitled; "AN ORDINANCE AMENDING SECTION 1157.03 <br />OF THE CODIFIED ORDINANCES OF MAYFIELD VILLAGE, OHIO, PROHIBITING <br />ROOMERS IN A CLASS U-1 AND U-2 DISTRICT AND REPEALING ALL ORDINANCES <br />INCONSISTENT HEREWITH." Introduced by Mayor Carmen and the Entire <br />Council. <br />Mr. Rinker arrived at this time (7:54 p.m.) <br />Mr. Ramos said that if a homeowner wanted to rent out rooms in their <br />home (tourist, sorority, fraternity, boarding, etc.) they would not be <br />permitted to do so if this issue is passed. He said that we do not <br />presently have any, but this would do away with them. <br />Ordinance No. 89-27, entitled; "AN ORDINANCE REPEALING SUBSECTIONS <br />1153.02(F)(8) AND 1153.02(F)(10) OF THE CODIFIED ORDINANCES OF MAYFIELD <br />VILLAGE, OHIO, ELIMINATING DOCTORS' AND DENTISTS' OFFICES AND RESEARCH <br />LABORATORIES AS A SPECIAL PERMIT USE IN A CLASS U-6 DISTRICT AND <br />REPEALING ALL ORDINANCES INCONSISTENT HEREWITH." Introduced by Mayor <br />Carmen and the Entire Council. <br />Mr. Ramos said that he felt there was alot of misunderstanding the last <br />time this issue was placed on the ballot. He said he thinks people <br />thought we were trying to eliminate these uses. We are just trying to <br />restrict them to those- specific areas that are zoned properly. Mr. , <br />Ramos said that by our present code, people may come to Council and ask <br />Council to grant them a special permit to locate in certain areas of <br />the Village. He said that Mayor Carmen and all members of this Council <br />feel they do not want to have that option available to Council. They <br />want to restrict such uses to the proper districts as defined under our <br />code. Mr. Ramos said by passage of this issue, we would be taking the <br />authority of Council to allow this type of use in areas that are not <br />property zoned. <br />Mr. Bill Marquardt, asked if these were the same issues that were on <br />the ballot in May being passed as ordinances.
