145 <br />MINUTES OF A SPECIAL MEETING OF COUNCIL <br />Mayfield Village <br />September 3, 1992 <br />The Council of Mayfield Village met in Special Session on Thursday, September 3, 1992, at eight <br />o'clock p.m. (8 p.m.) in the Council Chambers at the Village Hall. Council President Bruce <br />Rinker presided. <br />ROLL CALL: Present: Mr. Basile, Mr. Busa, Mrs. Cinco, Mr. Ferrante, Mr. Fixler, <br />Mr. Flynn, and Mr. Rinker <br />Absent: None <br />Also Present Were: Mayor Pietrafese, Mr. Amendola, Mr. Diemert, Mr. Hovancsek, <br />Chief Mohr, Chief Stevens, Mr. Toth, and Miss Heath <br />Mr. Rinker said the primary reason they are here tonight is to see if they can approve a resolution <br />concerning Parkview Golf Course. He asked if Council had anything before them. <br />Mr. Diemert said they have copies of the resolutions that were distributed to Council authorizing <br />the Mayor and Finance Director to enter into the settlement agreement. He said copies of the <br />executed copies of the agreement that Council wanted in its final formal form were delivered to him <br />this evening at the Police Department. Mr. Diemert said as you lrnow, they all have signatures <br />from all the parties. Mr. Diemert said although they signed most all of the documents, the <br />settlement agreement itself has signature lines in the middle of the agreement; they did not actually <br />sign the settlement agreement itself. If Council will trust that the Mayor will not sign this nor will <br />individual members of Council sign it until we have their signatures on it, he finds it okay to <br />authorize, by adoption of the ordinance, the settlement agreement. Then he will take the steps <br />necessary to im,plement the settlement. <br />Mr. Rinker said given the understanding that they have not fully executed their portion of the <br />agreement, their understanding was that they were ready to pass a resolution only effective based <br />upon their full compliance. He asked if Council can srill pass the resolution with an amendment <br />and make it condirional upon their full execurion. <br />Mr. Diemert said absolutely. <br />Mr. Rinker said that this is a formality; the resolution will have to be effecrive only upon <br />completion of that contingency. If Council adopts the resolution with the contingency, the <br />resolution still will not become final. Now if it is Council's position they want every "t" crossed <br />and "i" dotted before they even put this to a vote regardless of conringencies, they have to bear in <br />mind if they do so, they will likely have to reconvene a special meeting, Mr. Rinker said he is <br />suggesting they do this with the contingency so they can avoid that step. He opened the floor for <br />discussion. <br />Mr. Fenante said he personally will not agree to that. <br />f
