191. <br />Public Hearing <br />11/16/92 <br />Page Five <br />Mr. Friedman said he would also like to add, in response to Mr. Rinker's comments about timing <br />because he does not want it to be perceived that he is coming in on the eve of the final reading <br />when he had all of this time he refened to in his opening comments Mr. Rinker said more than <br />once, "for some time now", he believes the ordinance was introduced for its first reading at their <br />September meeting. They found out about it (not being notified in any way) by an interested party <br />in the community, some time between the first reading and the second reading. At which time he <br />contacted representatives from the Council and the Village to set up a time to discuss their interest <br />in working something out to avoid very cosdy lirigation. He believes they sat down on the day of <br />or day following the second reading; they have been scurrying around since that meeting to try to <br />come to this Council with a specific plan to discuss in more detail what they talked about and what <br />they had in mind. It was just physically, pracrically impossible to prepare anything of any <br />consequence in the last 20 or so days. Not only that, they made an attempt to hire. Mr. Hill to <br />represent them because of his reputation and because of his prior involvement with the Village and <br />the potential appearance of a conflict, it was determined that it would not be in the best interest of <br />the Village for Mr. Hill to represent them. They found that out a week or 10 days ago and hired <br />someone else and aze working with them. Mr. Friedman said he is here to say he thinks they are <br />close; they too would like to avoid protracted and cosdy litigation which inevitably they will be <br />involved in if this ordinance is passed in its current form. He said he cannot tell them how <br />important it is to give them the time to try to work something out so that they can at least come to <br />the voters of this Village with a plan that hopefully they can all agree to something that is workable <br />and that they will not challenge. He will answer questions if they would like. <br />Mr. Rinker asked if Mr. Friedman has an idea of a target date. <br />Mr. Friedman said he understands that they would like to be on the February ballot. He lrnows <br />that they have until the first part of December in which to norify the Board of Elecrions and take the <br />appropriate actions to be on the ballot. They were trying to avoid getting out too far in this process <br />and then bacldng off. He appreciates the Village's posirion on that. Whether or not they will have <br />a formal plan by the first week in December, he cannot tell them at this point. He can tell them they <br />will be close and he understands the problems relating to being on the ballot. He would say they <br />are probably two-three weeks away from being able to sit down on a preliminary basis with <br />something they are comfortable with and then the time necessary to tallc about the specif'ics with the <br />building departrnent and the engineer would take another couple of weeks to develop an ordinance. <br />They are talking in terms of weeks as opposed to months. <br />Mr. Rinker thanked Mr. Friedman for his comments.
