Introduced by Mayor Pietrafese and Council as a Whole. <br />Mr. Basile, seconded by Mr. Ferrante, made a motion to suspend the rules of Council requiring an <br />ordinance to be read on three separate occasions. <br />ROLL CALL: AYES: All <br />NAYS: None Motion Carried <br />Rules Suspended <br />Mr. Ferrante, seconded by Mr. Basile, made a motion to enact Ordinance No. 92-42. <br />Mr. Diemert said the parcels of land are located off of S.O.M. Center and Highland Roads behind <br />the Service Building (Permanent parcel numbers: 831-11-009 and 831-11-031). One of them <br />fronts Highland Road, the other is landlocked behind our property. <br />Mayor Pietrafese said the two in question are directly behind the Service Building and the third is <br />going to be an access or could be a channel between Highland Road and the Service Building. <br />Mr. Rinker said the Service Department and Engineer have endorsed this move and we need to <br />proceed. There are some concerns they they are proceeding by eminent domain, however, by <br />adopting this tonight (as has been explained by our Law Director) we will be announcing our <br />intention to appropriate this property which is clearly for a legirimate public purpose. <br />Mrs. Cinco said it was her intent to relate to Council that she would like to leave this on first <br />reading until she sees the correspondence from the Law Director and explained she was voting <br />"nay" because she would like to see a response from the property owners first. <br />Mr. Rinker said they have looked to a price far in excess of that appraised. <br />ROLL CALI,: AYES: Mr. Basile, Mr. Busa, Mr. Ferrante, Mr. Fixler, Mr. Flynn, and <br />Mr. Rinker <br />NAYS: Mrs. Cinco Morion Carried <br />Ordinance Enacted
