210 <br />Special Council Meeting 12/2/92 <br />Page Four <br />Third Reading of Qrdinance No. 92-34, entitled; "An ordinance revising the zone map of Mayfield <br />Village, Ohio, so as to amend the use classification of approximately two hundred acres of land <br />located north of Highland Road, west of S.O.M. Center Road, east of I-271, and south of the <br />northern property line of all Midvale Avenue lots, from its office laboratory district and production- <br />distribution distnct, to single family residential district (U-4)." Introduced by Mayor Pietrafese <br />and Council as a Whole. (First Reading 9/21/92, Second Reading & Amended 10/5/92, Second <br />Reading again 10/19/92, Public Hearing 11/16/92.) <br />Mr. Itinker said one of the things we had discussed was that Mr. Friedman came to a meering <br />before and addressed us as a body. He wants to have the opportunity to present more detailed <br />informarion about a proposal they think is something we should listen to and look at closely. Mr. <br />Friedman has indicated, and he has a letter of commitment, if we would afford them some <br />reasonable amount of time and not proceed moving to a referendum vote immediately, he needs an <br />opportunity to develop the proposal at more length. <br />Mr. Friedman said it is correct he has presented to representatives of Council a clraft of a proposed <br />letter which stated basically that they would not come in for a pemut under the existing zoning for a <br />period of time, and that the Village would agree not to take any further steps to rezone this <br />property. The time period under which we would agree--we suggested May, we understand that <br />may be March, and that is okay. At least it would give us some time to work on the proposal. Mr. <br />Friedman said they want the property to stay the way it is but are trying to come up with a' <br />workable solution. Mr. Friedman said he left the letter with the representarives of Council and Joe <br />Diemert. Mr. Friedman said, for the record, he is prepared to sign it. 1VIr. Friedrnan said if he is to <br />sign this letter, a resolution will be required by Council to authorize the Village to agree not to take <br />any acriQn. Mr. Friedman stated, for the record, he will sign the letter based on Council passing <br />the resolution. <br />Mr. Itinker said there have been some quesrions as to actual ownership and whether interest can be <br />assigned, that during this moratorium of time they could not be assigning this interest to someone <br />else. <br />Mr. Friedman said he could assign it as a practical matter but he has no intent of doing that. If we <br />did, we could be in violation of the agreement--maybe. <br />Mayor Pietrafese said we want you to tell us you will not assign interest to anyone else. <br />Mr. Friedman said I am telling you that to the extent that I assign my interest, it will be subject to <br />my agreement with the Village. <br />Mr. Rinker said they are on the third reading of the ordinance and suggested their commitment be a <br />motion to table--or is W. Friedman looking for a more affumative act? <br />Mr. Friedman said you decide parliamentary-wise how to handle it. He needs a resolution in order <br />to feel the Council has authorized to commit for the Village to agree to what he has asked the <br />Council and the Village to agree to in his letter. <br />Mr. Rinker said we could commit to agree tonight. <br />
