Introduced by Council as a Whole. <br />Miss Trask, seconded by Mr. Carmen, made a motion to suspend <br />,the-rules ~of~`l-ate requiring a resolution to be read on three <br />separate occasions. <br />Roll Call: AYES: All <br />NAYS: None <br />Motion Carried <br />Rules Suspended <br />Mr. Carmen, seconded by Miss Trask, made a m-otion to pass <br />Resolution 80-46. - <br />Roll Cal'1: AYES: All <br />NAYS: None <br />Motion Carried <br />Resolution Passed <br />Mr. Bennett asked for closing comments as an Executive Session <br />would be held before the meeting adjourned. <br />Mr. Amendola commented that those responsible for the signing <br />of the legislation passed at each meeting to please be sure they <br />take care of this duty so as to avoid the necessity of running <br />around to get their signatures. <br />Mr. Bennett stated the-village is having problems with the <br />utilities ~nd~their subcontractors with regard to the follow <br />up work after repair work is done. Is there any way the Village <br />can demand a cash bond before this work is started: <br />Mr. Amendola reported that ordinance exempts the utilities. <br />Mr. Feneli commented the Village had won a lawsuit regarding.. <br />damage to a citizens vehicle due to a hole left in the road by <br />the Water Department. The Judge ruled the Cleveland Water <br />Department was at fault. The utilities maintain that there <br />exists a contract between the Utility Companies and the Village <br />that they make the repair and the Village is responsible for <br />the restoration of the site; no one can produce this contract. <br />Mr. Flynn suggested a bond be rgquired when they repair the <br />feeder lines. <br />Further discussion was held with the Law Director to prepare <br />legislation establishing the requirement of a bond before <br />repair work is done. <br />1 <br />1 <br />Mayor Beebe stated he had been at the Cotton residence between <br />7:30 & 8:00 A.M. Apparently the Contractor doing the worl~ is <br />still not finished to their satisfaction. <br />
