26~ <br />Ordinance 80-48, entitled: "AN EMERGENCY ORDINANCE AUTHORIZING <br />SETTLEMENT OF A LAWSUIT BY THE PAYMENT OF THREE-THOUSAND-FIUE- <br />HUNDRED DOLLARS ($3,500.00) PLUS COURT COSTS, TO LAWRENCE J. FLYNN <br />AND WEISMAN, GOLDBERG & WEISMAN, HIS ATTORNEYS." Introduced by <br />Counc.il_ as a Whole. ~ " <br />Given Second Reading. <br />Mr. Bennett stated there would be a Special Council Meeting on <br />Wednesday, July 23, 1980 at 8:00 P.M. to select a person to fill <br />the vacancy on :Council. <br />Mr. Bennett asked Mr. Carmen if he wished to make a"presentation <br />on the survey taken regarding the replacement.on.Council. " <br />Mr. Carmen explained the survey was done, with assistance from <br />some residents and Mr. Spellman, to help them select a replacement <br />for Mr. Boger. Those questions asked were to primarily get the <br />feeling of the residents as to how a candidate should be selected - <br />by appointment from eligible persons or should the next highest <br />vote getter get the position. He requested the survey results, of <br />which Council, the Mayor, and the news media were given copies, be <br />made a part of the minutes. (See attached-) <br />Mr. Bennett commended Mr. Carmen, Mr. Spellman as well as the others <br />who assisted ~ia.'`~this project. <br />Mr. Marquardt, 6698 Wildwood Trail, stated he would lilce to comment <br />on two things: <br />(1) He was a recipient of the survey call and felt those doing the <br />calling were opposed to Mr. Busa being appointed. <br />Mr. Carmen replied this was untrue as all callers. were instructed to <br />ask the same questions. •j _ <br />(2) Mr. Marquardt asked if anything further had been decided.on_the <br />closing off of Zorn Lane at Wildwood Trail"? <br />Mr. Feneli stated that Council Yias•the power to close the s~creet but <br />justification must be shown. <br />Mr. Marquardt stated the speed/volume of cars coming from Wildwood <br />Trail and Timberline Trail are becoming a hazard. <br />Mayor Beebe commented that the majority of people using the road is <br />to gain benefit of the traffic signal. <br />Mr. Feneli stated the situation will wind up in the Law Department <br />and the decision could become precedent setting. Other residents <br />would then have the same right to close off other areas. <br />Mr. Bennett stated that due to the :easement for the sanitary sewer <br />of the Galier/Carlini.project now being under County jurisdiction, <br />the ordinance introduced ,at the last meeting under number 80-44 in <br />title only would be void .and the number would be available for <br />reasignment. <br />
