26~ Ordinance 80-48, entitled: "AN EMERGENCY ORDINANCE AUTHORIZING SETTLEMENT OF A LAWSUIT BY THE PAYMENT OF THREE-THOUSAND-FIUE- HUNDRED DOLLARS ($3,500.00) PLUS COURT COSTS, TO LAWRENCE J. FLYNN AND WEISMAN, GOLDBERG & WEISMAN, HIS ATTORNEYS." Introduced by Counc.il_ as a Whole. ~ " Given Second Reading. Mr. Bennett stated there would be a Special Council Meeting on Wednesday, July 23, 1980 at 8:00 P.M. to select a person to fill the vacancy on :Council. Mr. Bennett asked Mr. Carmen if he wished to make a"presentation on the survey taken regarding the replacement.on.Council. " Mr. Carmen explained the survey was done, with assistance from some residents and Mr. Spellman, to help them select a replacement for Mr. Boger. Those questions asked were to primarily get the feeling of the residents as to how a candidate should be selected - by appointment from eligible persons or should the next highest vote getter get the position. He requested the survey results, of which Council, the Mayor, and the news media were given copies, be made a part of the minutes. (See attached-) Mr. Bennett commended Mr. Carmen, Mr. Spellman as well as the others who assisted ~ia.'`~this project. Mr. Marquardt, 6698 Wildwood Trail, stated he would lilce to comment on two things: (1) He was a recipient of the survey call and felt those doing the calling were opposed to Mr. Busa being appointed. Mr. Carmen replied this was untrue as all callers. were instructed to ask the same questions. •j _ (2) Mr. Marquardt asked if anything further had been decided.on_the closing off of Zorn Lane at Wildwood Trail"? Mr. Feneli stated that Council Yias•the power to close the s~creet but justification must be shown. Mr. Marquardt stated the speed/volume of cars coming from Wildwood Trail and Timberline Trail are becoming a hazard. Mayor Beebe commented that the majority of people using the road is to gain benefit of the traffic signal. Mr. Feneli stated the situation will wind up in the Law Department and the decision could become precedent setting. Other residents would then have the same right to close off other areas. Mr. Bennett stated that due to the :easement for the sanitary sewer of the Galier/Carlini.project now being under County jurisdiction, the ordinance introduced ,at the last meeting under number 80-44 in title only would be void .and the number would be available for reasignment.
