<br />Mr. Feneli.stated that he would like to speak about the litigation <br />portion of this meeting, mentioned on the Special Meeting Notice. <br />He stated that it has been determined that a new President of <br />Council must be elected, which raises the following questioris: <br />(l) Who is to preside until a new Council President is elected? <br />Mr. Feneli explained that the Charter does not specifically state <br />in what time period a new Council President must be chosen, but <br />if Council does mpt make a decision within 30 days that the Mayor <br />would make the appointment. He explained that accor.ding to State. <br />Law since our Charter does not state'oth"erwise, that the President <br />Pro Tem, Lawrence.J. Flynn,.will preside until such time as a new <br />Council President is elected. <br />(2) In the ev,ent.of a tie, whe.n Council votes, does the Mayor <br />have the riglit to 'break ??a tie? ' -" " - - -- . - <br />Mr. Feneli stated that in the event of a tie vote, the Mayor does <br />have the right to make'a decision by castirig his vote to break the <br />ties He stated that the Mayor is not required to vote, but has <br />the option of doing.so. He stated further that the.new.Council <br />President could.be elected by a plurality, and would not have to <br />be elected by a majority. However, the Mayor would only be able <br />to ca-st his.vote in the case of br.eaking a tie vote. Mr. Feneli <br />stated that'a new election for President Pro Tem would only be <br />necessary if the President Pro Tem became the new Council.President. <br />There b-eing no further questions or discussion,. Mr. Flynn stated <br />the floor was open for-.nomi:nations for Council President. <br />Miss Trask, seconded by Mrs. H;anus, nominated Mr. Busa. <br />Mr. Spellman, seconded by Mr. Flynn, nominated Mr. Carmen. <br />There being no other nominations, nominations were closed. <br />Lawrence J..Flynn to. remain as President Pro Tem. <br />Roll Call: Choice for new President of Council: <br />Busa <br />C armen <br />Flynn <br />Hanus <br />Spellman <br />Trask <br />Busa <br />Carmen <br />Carmen <br />Busa <br />Carmen <br />Busa <br /> <br /> <br />?
