n <br />r a_ <br />? <br />Mr. Feneli stated he will prepare an ordinance for the Love <br />Insurance Agency for the Special Meeting of December 14, and <br />should the contract be awarded to_Conway & Conway the ordinance <br />could be passed in title. <br />Mro Spellman asked Mr. Feneli about the status of.the Cotton <br />case which is in litigation. <br />Mr. Feneli stated the Cottons are claiming the stonework.we <br />put around the drain outlet, which before was just a protruding <br />corregated pipe, is an attractive nuisance. He stated they are <br />suing the Village for $3,500.00 damages to their proper.tyo Mr. <br />Feneli stated we had previously offered them $500.00 for damages <br />to trees, etc. but anymore than that would be unreasonable. He <br />clarified the drain outlet is on their property, on which the <br />Village owns a 20 foot easement.. Mr. Feneli explained that <br />Engineer Hovancsek, Commissioner Amendola, the landscaper and <br />architect who worked on the Cotton property all contend the <br />Cotton property was improved by the Village. <br />Mr. Carmen questioned if the Co.ttons would be liable in the event <br />they were sued for an attractive nuisance. <br />Mr. Feneli stated he did not feel the Cottons wanted to be in <br />the position to be sued, it was not just a matter of who would <br />be liable. <br />Further discussion was held. <br />Mr. Busa, seconded.by Mr. Etzler, made a motion to authorize the <br />Law Director to respond to the lawsuit. <br />Roll Call: AYES: All <br />NAYS: None <br />Motion Carried <br />Authorization Given <br />Discussion was held regarding the scheduling of a meeting with <br />the Department Heads, Mrs. Ruggles, the Finance Committee, and <br />any member of Council who wishes to attend, to discuss the line <br />items in the appropriations budget, wage adjustment and benefits <br />for 1982. <br />The meeting to be held on Tuesday, December 15, 1981 beginning <br />at 7:00 P.M. <br />There being no further business, Mr. Etzler, seconded by Mrs. <br />Hanus, made a motion to adjourn the meeting. <br />The meeting adjourned at 9:10 P.M. <br /> <br />
