Mr. Feneli stated he will prepare an ordinance for the Love Insurance Agency for the Special Meeting of December 14, and should the contract be awarded to_Conway & Conway the ordinance could be passed in title. Mro Spellman asked Mr. Feneli about the status of.the Cotton case which is in litigation. Mr. Feneli stated the Cottons are claiming the stonework.we put around the drain outlet, which before was just a protruding corregated pipe, is an attractive nuisance. He stated they are suing the Village for $3,500.00 damages to their proper.tyo Mr. Feneli stated we had previously offered them $500.00 for damages to trees, etc. but anymore than that would be unreasonable. He clarified the drain outlet is on their property, on which the Village owns a 20 foot easement.. Mr. Feneli explained that Engineer Hovancsek, Commissioner Amendola, the landscaper and architect who worked on the Cotton property all contend the Cotton property was improved by the Village. Mr. Carmen questioned if the Co.ttons would be liable in the event they were sued for an attractive nuisance. Mr. Feneli stated he did not feel the Cottons wanted to be in the position to be sued, it was not just a matter of who would be liable. Further discussion was held. Mr. Busa, seconded.by Mr. Etzler, made a motion to authorize the Law Director to respond to the lawsuit. Roll Call: AYES: All NAYS: None Motion Carried Authorization Given Discussion was held regarding the scheduling of a meeting with the Department Heads, Mrs. Ruggles, the Finance Committee, and any member of Council who wishes to attend, to discuss the line items in the appropriations budget, wage adjustment and benefits for 1982. The meeting to be held on Tuesday, December 15, 1981 beginning at 7:00 P.M. There being no further business, Mr. Etzler, seconded by Mrs. Hanus, made a motion to adjourn the meeting. The meeting adjourned at 9:10 P.M.
