MINUTES OF A REGULAR MEETgNG OF COUNCIL <br />Ma.yfield ViUage <br />June 16, 1997 <br />The Coiancil of Mayfield Village met in regular sessiun on 1Vlonday, June 16, 1997, at 5:00 p.m. in <br />the Mayfield Village Senior Center/Community Room. Council President I'ro Tem Joa.nne Cinco <br />presided. <br />ROLL CALL: Present: Mr. Buckholtz,lVlr. Busa, Mrs. Cinco, Mr. Ferrante, <br />Mr. Marquardt and Dr. Parker <br />Absent: N1r. Fiyder <br />Also Present: Mayor R.inker, Mr. Brett, Mr. Cappello, Mr. Diemert, <br />Mr. Hovancsek, Mr. Metzung, Chief Mohr, Mr. Sama.c, <br />Chief Stevens and Miss Heath <br />OI'EN PORTICII'+1 <br />Steve Senkfor, 796 Hanover Road, said he is seeking the help of Mayor Rinker, Council and the <br />Law Director. He has lived in Hanover Woods for 6 years. About 9 months ago, construction <br />started on the house next to him. There is a sheer drop between the properties. His wife had <br />started speaking to Berrue Samac about 6 months ago; he wrote a letter to Bernie about 6 weeks <br />ago with a copy to the Mayor. Really, nv#hing was addressed until he spoke to Councilman <br />Parker who convened a meeting at which point they constructed a construction fence so there was <br />some temporary safety for his children who are three and one. To date, that is ali that has <br />occurred. He was told at the time, quoting a letter from Bernie, after 3 sunny days they would <br />start work on a retaining wall. Nothing has been done to date and we have had a number of <br />sunny days in the Iast 3-4 weeks. He is concerned because there is no pern2anent solutiQn. He <br />has asked to have approval of whatever tiered wall is going up. No timetable has been set and he <br />has nothing in writing saying he will be abie to approve anything. All he is looking for is safety <br />for his chiidren so they can play in his back yard. Also, there are cracks occurring inside his <br />home. Whe#her or not they are related-Mr. Samac believes they are not but he hasn't spent <br />the maney to find out. All he can teIl us is they weren't there 9 months ago and they are there <br />today. Fie wants a permanent solution. He does not understand why the house was approved in <br />the first place; it is set way back from any other house in the deveiopment. Obviausly it is within <br />code or it would have never been approved but he does not understand why it's allvwed to ha.ve a <br />dangerous condition. All he wants is safety. The oniy possibie solution he sees is some sort of <br />barrier between the properties. From what he understands he can't even do that in 1VlayfieId <br />Village or in Hanoeer Woods because he can't build a fence. He does not want to spend the <br />money to do it anyway. Before construction started, his kids were safe-now he can't even put <br />them in the back yard without making sure they don't go to the back property where the <br />construction fence stops. He hired counsel today. A letter was sent today to Bernie Samac and <br />Mayor Rinker was copied on it. Because of the condition that exists, he cannot seIl his property--
