He is aware Mayfield
Village has tried to mediate a dispute on a border lot where grade level changes were not
apparent until digging began. He asked 1VIr. Samac to give some history on this.
Nft. Samac said he, the Village Engineer, the architect and builder constructing the house, an
attomey representing the owner of the property attended the meeting. Mr. 5enkfor and Mr.
Basconi were unable to attend the meeting due to deaths in their families. Everyome wallced the
site and agreed the best way to address the situation was to build the landscaping wall in a tiered
method. The builder and his attorney were to get back to Mr. Bascani to review everything. We
thought it was a done deal and all of a sudden Mr. Basconi is unhappy with him because this will
cost him thousands of dollars. From the onset of this project, the lot rec}uired the house to be set
back to avoid problems with soil conditions.
Mayor Rinker asked if there are any engineering questions and if tllis is an appropriate way to deal
with it.
Mr. Hovancsek said it was a difficult Iot to build and one of the last lots to sell. He recommended a meeting be held with the
owner and the contractor. He thought everyone had agreed on the wall.
Mr. Senkfor said he appreciated the letter from Mr. Sama.c; it was a timely letter. However, there
was no timetable and no approval.
Dr. Parker said when he spoke to Mr. Basconi he was not sure this was etched in stone. He
thinks he needs to understand it is a safety issue.
Mayor Rinker said we could set up a timetable and we will 1et everyone know.
Mr. Buckholtz asked if the house is still under construction and who the builder is.
Mr. Samac said Sky Builders.
Mayor Rinker said we must firm up two items: 1) what the plan will be (a tiered wall); and 2)
what the timetable will be (for everyone to work off of.)
