Regular Council Meeting <br />12-8-97 <br />Page 8 <br />Mayor Rinker said part of the discussion was for the benefit of the Engineer, in thP indication from <br />Mr. Bialosky, he was pointing to the #3 scenario and showing that at that cross-intersection that the <br />road that is coming in from White Road would be stubbed offas it were in that vicinity which would <br />allow then from a point south for the road there to be able to cut offto the southviest in the vicinity <br />of that intersection. <br />Mr. Brett questioned the legal description. <br />Mayor Rinker said we will have the Law Director draft a legal description and cotuisel from <br />Progressive can take a look at it. He thinks they will have to state it in the alternative that it will <br />either be a straight line or will allow for the angle. For purposes of the initial development, you will <br />deal with the worst ease scenaxio. If there is any adjustment, it will be slight. <br />Mr. (Jack) Bialosky said it won't have a legal description, but there will be a drawing that goes with <br />it. <br />Mayor Rinker said we will include that as an addendum to the agreement. <br />1VIr. Cappello said regarding the question of the angle, when the legal description is written could it <br />be written with it being flat or at an angle. <br />Mayor Rinker said he thinks they will show it at the angle. <br />Mr. Cappello said we will want to incorporate the Corps of Engineers input. <br />Mayor:Ririker said part of the addendum language to this purchase agreement will address future <br />contingencies attendant upon the Corps of Engineers' determination. The Corps of Engineers will <br />have a major say of where the road (the interior boulevard) can cross the wetland area that is <br />currently on the Friedman site. <br />Mr. Hovancsek said he would like to have that exhibit for their use since they do not have a copy. <br />Mayor Rinker asked the representatives from Progressive to label the exhibit as "F,xhibit A" and <br />date it tonight. <br />Roll Call: AYES: All <br />NAYS: None Motion Carried <br />Purchase Approved <br />A motion to authorize an amount not to exeeed $3,500 to IVlayfield Schools for custodial <br />fees for basketball
