Minutes of a Special Meeting of Council <br />6/12/00 <br />Page 5 <br />Mr. Buckholtz stated he is not in favor of granting a variance just for the sake of granting a <br />variance. He was in favor of opening up Beta Drive to office, medical or whatever. He further <br />stated that he would be in favor of granting the variance in hopes that this would be the catalyst <br />for moving things along opening up Beta Drive. Since the Special Use Permit has been repealed, <br />since they cannot deal with that particular tenant in that situation, then he would not be in favor <br />of granting that variance just to grant it for the building itself. Mr. Buckholtz advised if there <br />was a viable tenant, then he would certainly be interested in looking at a variance at that time. <br />Mr. Buckholtz stated that he knew there were various Planning and Zoning members in the <br />audience and he welcomed comments from them. <br />Dennis Robasky from Panzica said he could understand the Special Use Permit from a medical <br />standpoint and the two variances, one of which would reduce the green area in front and the <br />other variance on the number of parking slots, in this case it was for medical. He said that the <br />reduction of the setback was based on this particular tenant for their business reasons. He further <br />stated that he felt the number of parking space requirements was too restrictive for possibly any <br />other office tenant, not necessarily a medical tenant. He stated tenants would go elsewhere, <br />where the restrictions were less restrictive. <br />Mr. Buckholtz stated he came in here wanting to get tenants in, but doesn't want to grant a <br />variance without an actual tenant in mind. Mr. Buckholtz asked for clarification of what a yes <br />vote meant and what a no vote meant. <br />Council President Marquardt advised a yes vote would repeal the variances; a no vote would let <br />the variances stand. <br />Council President Marquardt said his view on the Special Use Permit and variances was this was <br />an act of rezoning. The combination of the Special Use Permit and variances changes that <br />property from warehouse distribution to office and the change of zoning in Mayfield Village per <br />charter is the right of the electorate, not the right of Council, not the right of Board of Zoning and <br />Appeals, not the right of Planning and Zoning Commission, it is the right of the electorate. <br />Mr. Ilacqua stated he would like to echo Council President Marquardt's thoughts, that they are <br />very much aligned with his. <br />Dr. Parker thinks similarly but that doesn't say that we can't look at future uses on Beta but we <br />need to do it in a systematic way that addresses these issues of rezoning. <br />Mrs. Mills said the people sitting here from these two boards, Planning and Zoning and Board of <br />Zoning and Appeals spent a lot of time coming to a decision for the benefit of the community. <br /> <br />
