Minutes of a Special Meeting of Council <br />6/12/00 <br />Page 4 <br />Mr. Diemert advised for the Special Use Permit, it has been repealed and you can go onto <br />variances that have been objected to that the Board of Zoning and Appeals considered at its last <br />meeting. <br />Mr. Samac advised this was not for Hilmed. The variances granted was for use with the lesser <br />number of parking spaces and for the setback at 731 Beta Drive. <br />Mr. Diemert read the original variances granted. Mr. Diemert further advised the Board of <br />Zoning and Appeals adopted those at their meeting of May 31, 2000. <br />Council President Marquardt asked what the action was for tonight. <br />Mr. Diemert advised that Council objected to the variances at the last work session and it was <br />communicated to Mr. Samac within the time period required; therefore, there is now the <br />consideration of those two variances and it would probably be appropriate at this time to make a <br />motion to confirm, or to reverse or to modify the actions of the Board of Zoning and Appeals on <br />either of those variances. <br />Council President Marquardt opened the floor for a motion to repeal those actions of the Board <br />of Zoning and Appeals. <br />Mr. Diemert advised you needed 2/3~S majority vote to repeal the actions. Mr. Diemert advised <br />since we only have six Council persons here tonight, you would need four votes to reverse the <br />Board of Zoning and Appeals. You do not have to count all elected. <br />Council President Marquardt advised he would consider a motion to reverse the variances <br />granted by the Board of Zoning and Appeals. <br />Mr. Busa, seconded by Mr. Ilacqua made the motion. <br />Council President Marquardt opened the floor for discussion. <br />Mr. Buckholtz wanted clarification of the parking variance and setback variance if they do not <br />have a Special Use. <br />Mr. Diemert said anyone then could use the property, it was not contingent on medical use, for <br />the setback; however, the 37 parking space variance did relate to medical use and that now it <br />would give a 37 parking space variance, whether it was for medical use or not. Mr. Diemert <br />advised the setback for that building is 100' back and they wanted to reduce that setback to 60'. <br /> <br />
