Regular Council Meeting <br />6-19-00 <br />Page 11 <br />Council President Marquardt opened this up for discussion. <br />Mr. Ilacqua advised that they discussed this in length at the Finance Committee. <br />Mrs. Cinco, seconded by Mr. Ilacqua, made a motion to authorize an expenditure for the change <br />order of a net $ 2,6300.00 to Landscape by Design. <br />Council President Marquardt opened this up for further discussion; he asked if we were going to be <br />satisfied with what is going on. <br />Mr. Buckholtz felt more discussion tonight was needed. <br />Mr. Thomas said the Recreation Board planned Parkview Playground in mind with all safety <br />standards and that is what we have done. The contractor, in his haste to move the project along, put <br />down cement curbing to keep the poured-in-place to form it. Mr. Thomas felt he should have put the <br />playground equipment in first before pouring any type of cement structure in. The Recreation Board <br />saw the curbing that was too close to the playground equipment. Mr. Thomas advised that Mr. <br />Ilacqua has pictures of this. The curbing was too close to slide structures. Mr. Thomas also noticed <br />a six foot fall zone was not in the playground as far as safety, which is an actual code which must be <br />followed when building playgrounds. At that point, we stopped all construction on this project. We <br />wanted to make sure we had a safe playground to be used by all the children. Again, the <br />recommendation from the Recreation Board is that we do not want to have any exposed cement on <br />the playground and it is their recommendation to cover up the top part. The plans were to take the <br />poured-in-place to the top on each side of the curbing but leave the top curbing flush with the rest of <br />the playground. Mr. Thomas said we can use our $ 8,000.00 contingency to pay for this $ 2,630.00 <br />expense. Mr. Thomas advised that the other $ 14,000.00 or so that is part of a fall zone problem is a <br />contractor's problem and not the Village's problem. <br />Mr. Metzung asked if these figures have been discussed with the contractor and Mr. Thomas advised <br />no, it is with the legal department right now. <br />Council President Marquardt then said that this may not be the last expenditure. <br />Mayor Rinker said it was his understanding that the contractor has acknowledged he took things out <br />of sequence. Based upon that, we referred it to our legal counsel. Mayor Rinker further advised that <br />when the equipment was installed, the error became evident and construction was stopped. <br />Council President Marquardt asked who defined the layout for the curbing layout. <br />Mr. Thomas said it was either with the manufacture that deals with the poured-in-place because you <br />need to have curbing in order to give it a form. <br />Council President Marquardt asked who defined the area around the equipment. <br />Mr. Thomas said it was the architect that designed the playground. <br />
