Our understanding is that whether we go with them or not, <br />they are still going to use that wellhead site. <br />Dr. Parker asked where the other site is exactly. Mayor Rinker replied all we know is it is across <br />the street. He does not know if it is in the hidden woods area. Dr. Parker knows there are <br />concerns as far as the sounds and the smell. Mayor Rinker indicated that if there are specific <br />questions, we can add them to those that Planning and Zoning has requested to the Law <br />Department. This would be a good time to do it so that we can get confirmation back. It looks <br />like we are getting information back from this, but in addition to documentation, if we have <br />specific written questions, we can get those answers and it will help to clear the air. We seem to <br />be going over a lot of these more than once. Dr. Parker did not know if the amount of money we <br />get is worth giving up for one less wellhead in that area. If not, then fine. <br />Council President Buckholtz suggested we leave this on first read since obviously there is still <br />some information out there. He has had discussions with Mr. Giordano just keeping him <br />apprised of our process. We are trying to keep everyone informed. This will take us to another <br />Caucus and Planning and Zoning meeting to get more information. What the Mayor is saying if <br />you want to articulate specific questions, more so than even tonight, there is time to do that. If <br />there is a way to diagram how it works with the acreage with us or without us, because it was <br />real clear at the last Caucus that they are going to do the proj ect, they are going to have the <br />assemblage with or without us. It's one of those deals. We can do it one way and make it a little <br />better for them and we profit and then you can have something to balance. That will come down <br />to everyone's opinion, which is what we are here for. We have the time, so we should take it, <br />move as quickly as allowed, but at the same time answer everyone's questions. <br />Mayor Rinker added that Mr. Diemert has already initiated a line of communication and <br />negotiation so that we will be in a position to have a meaningful vote. <br />Dr. Paxker said this was brought up in Finance, but the way the legislation is written, does this <br />require Council's approval regardless? Mr. Diemert replied that he drafted it so that Council <br />could authorize the Mayor to go ahead and negotiate it, but he put the money amounts in there <br />and the locations. Dr. Parker said it says "enter into". They did not know whether that meant it <br />still required Council approval. Mr. Diemert stated not after you adopt this because the key <br />elements are there in the ordinance. It gives the Mayor the flexibility that if we do not get all of <br />the information we requested, then the Mayor will not enter into the Agreement because it won't <br />have all of the contingencies that we were looking for. <br />Dr. Parker asked if this is passed, will Council come back to vote on it again? Mayor Rinker <br />said you would not. The idea is you have to have a comfort level before you pass it. Tonight's <br />not the night because we feel there are too many conditions. When we were here, we were aware <br />that it was time-driven. It behooved us at least to get going in the right direction. <br />Council President Buckholtz asked if everyone was on board with that. Everyone was. <br />This Ordinance will be left on First Read.
