Regular Council Meeting <br />9-15-08 <br />Page 13 <br />Council President Buckholtz asked if there was any discussion. <br />Dr. Parker stated that he assumes Heinen's is going to use the patio portion. Why wouldn't they <br />offer to pay for it? <br />Mr. Marquardt said this was not brought up at Caucus. <br />Mayor Rinker said this was part of the plan before we entered into the whole arrangement <br />months ago, that we would have to put some kind of landscaping and feature in there. This is not <br />new. We could always opt for concrete. We thought that pavers would be far nicer. Part of the <br />discussions we have had for the Town Center, discussions over the past few years, the Planning <br />Development Committee has looked at it. We have talked about the potential for the property <br />behind us here as to whether or not that could be utilized in some way. Mayor Rinker wrote <br />about it in the Voice of the Village. We have talked in general terms and very specific terms <br />about what we want to do with that north entryway. Heinen's is bearing the cost of the structural <br />change there. Planning and Zoning made the approvals for them to be able to that. We have <br />understood all along that they are going to be coming out that north side. Part of our leasing <br />arrangement and the quid pro quo that we have done with tying into the two parking lots and the <br />paving that goes through there is that because it is on our property we would design and basically <br />utilize that. While it is an access point to Heinen's and the overall maintenance, the underlying <br />agreement to it is that we would design and install this portion of it. We saw it as an amenity as <br />part of this kind of a courtyard arrangement we are trying to develop to encourage between the <br />Civic Center, the Jadd Mall, Heinen's and eventually whatever we do on the west side of the <br />property. The specific issue of Caucus, Mayor Rinker would agree, he does not think this was on <br />there, but in concept, we have always talked about putting that in and the idea that we have <br />pavers in there was to Mayor Rinker's knowledge something that we all generally understood. <br />This is the first time we have gotten the specs on the amount. Mayor Rinker's understanding is <br />that this was part of what was discussed in front of Planning and Zoning from the very <br />beginning. <br />Mr. Marquardt said the details were never discussed. He does not believe he has seen any kind <br />of documentation as to what our responsibilities are. <br />Mayor Rinker stated we have lease agreements. There are a lot of things Council has already <br />passed upon. Council President Buckholtz added that this was not on the last Caucus, but it was <br />definitely in Planning and Zoning, Planning and Development, and BZA. We have seen the <br />drawing. We have seen the plans. It was definitely outlined that they were going to do the <br />doorway. We were the ones that requested that they open it up to the north. That was specifically <br />stated in a meeting with the representative of Heinen's. Someone asked why we are doing this <br />and his response was, the Village approached us as opening this up. It was the idea of us <br />building a courtyard kind of situation, creating a mall or piazza, the roadway, the whole deal. <br />Council President Buckholtz saw the requisition come through. We did not talk about it at the <br />last Caucus, but then immediately he remembered and looked through a couple meeting notes.
