Regular Council Meeting Minutes <br />2-16-09 <br />Page 36 <br />Dr. Parker asked, are referring to the e-mail that just came out? <br />Mayor Rinker said that e-mail that just came out refers to a comment, an observation that <br />was made weeks ago by the same individual that made it in the e-mail. In Planning and Zoning <br />he said I think so. I remember explicitly saying check your deed. <br />Dr. Parker said, whether those are deed restrictions or not does not preclude someone <br />from signing a lease because they have to be enforced. <br />Mayor Rinker asked, why are you making it so complicated? <br />Dr. Parker said, let's just drop it, I understand. <br />Mayor Rinker said people have a responsibility to themselves. Don't expect your <br />government to do the whole thing. <br />Dr. Parker said no one is expecting the government to do anything. <br />Mayor Rinker said he's not so sure. <br /> <br />Council President Buckholtz said, so far we can't manage this thing any which way. The <br />State mandates sets forth this thing. Everybody wants some kind of local control. Bruce is just <br />suggesting, okay, you want local control? Get five houses at a time on your street and decide <br />something amongst yourselves and then nobody will accumulate 20 acres, that's all you're <br />saying. We are trying. We have spent 150,000 hours trying to examine the situation. <br />Dr. Parker said he thought he heard Mrs. Cinco say it was something different. <br />Mayor Rinker said you understood her correctly, but the characterization you just heard <br />about it today, he's also disputing that. This was raised weeks ago. If people don't <br />communicate, that's what we are being criticized, that we have not communicated. The problem <br />is we have been so close to this thing. We have drilled this issue to death. We assume everyone <br />else has picked up on it. Frankly with all of the representation here, he is surprised that more <br />residents don't know with all of the media coverage. Apparently that's a fact. We will take care <br />of that as best we can. What facilitates the dialogue all the way around though are strategies <br />that work. That's what P&Z looked at. <br />What Mayor Rinker is telling you tonight, if it's not a deed restriction, so be it, but you <br />certainly have the ability to do that. The fact that homeowner's associations exist at all, we <br />have said it time and time again, is a good thing. It shouldn't just be for parties and for <br />beautification. It should be issues like this that matter that should bring everyone together, <br />assemble and do it. It shouldn't just be when it's a negative and you're upset. It can be <br />something proactive and very constructive. Maybe this is a good opportunity to do it. Mayor <br />Rinker would urge that you promote that with your neighbors.
