Minutes of the Regular Meeting of Council
Apri124, 2006
Page 3
example home rule powers, the power of local control if it is viewed as being in conflict with
this provision by operation of law would be cancelled out. That would be the argument. There
is no question that this is going to spawn. Forget the taxpayer's suits: Just look at all of the
various government entities that will need to go to the courts, petition the courts for
clarification, justification or authorization. It really opens up truly a pandora's box of
formalized contention for language that is really very ill-conceived. The one experience that this
has seen in the country is in Colorado. We have got a disk tliat was provided through the
Chamber of Commerce in the State of Colorado. Ultimately iri the State of Colorado, they
suffered some real consequences as this editorial points out and we have seen elsewhere.
Colorado fell to SOth place for public school funding. The list seems never-ending. Given the
fact that this is of such potency, it behooves us to agree with so many other voices out there that
axe saying this is bad for the State of Ohio. It is bad for us locally and it is bad across the state.
It is not well thought out. It truly seems to be motivated by politics and in terms of a bi-partisan
voice, it is appropriate for us to speak out against it as well. We should encourage discussion
here.
Ironically, the person who has championed this and succeeded in putting a voice to this
measure so that it would get on the ballot when given an opportunity for equal time in front of
the Mayors and Managers, inexplicably cancelled at the last minute. Mayors and Managers is a
group of elected public officials with almost 60 communities represented in the County alone.
They had set aside special time because a number of the membership said we want to hear both
sides of the issue. When given an opportunity, the person who had been championing it just
cancelled at the last minute. It is very concerning that this has been turned in to a political
football when we are talking about the lifeblood of every public institution. It is very sobering
at the least. Mayor Rinker commended all to read it. The Resolution at very least should be on
a first read tonight and this is something that we should not hesitate to support.
COMAIIENTS FROM COUNCIL PRESIDENT BILL BUCKHOLTZ
Council President Buckholtz had no comments other than to say that he is in full agreement
and in fu11 support of what the Mayor said. He has been inundated with articles and e-mail messages
about this. He is following it as well and agrees that we should oppose the tax expenditure limitation.
DEPARTMENT HEAD REPORTS:
SERVICE - Douglas Metzun2
Mr. Metzung reported that some of our projects approved last year have begun with the
paving of the parking lot at the Civic Center. Thank you Specialized for paving the area in front
of the door early this morning so that it would be available for parking this afternoon. They are
working around the Service Department. Avoid that area at this time. It is a mess.
Mr. Metzung also reported that they have been working diligently in prepaxing the new
ballfields which are beginning to really shape up for the opening. Benches are being assembled.
Bleachers are being assembled. We will be ready.to play ball opening day.
