Minutes of the Regular Meeting of Council <br />September 25, 2006 <br />Page 2 <br />travels those streets? The residents, the police, the fire department, the service, everybody travels <br />them. They are traveled all the time and they are dangerous. Those streets are not just a potential <br />accident, they are a potential lawsuit. Citing from the Ordinance, Mrs. Eisenberg read that Ohio law <br />states that communities have to keep their streets and sidewalks free from nuisance. If someone is <br />injured because of a known nuisance, that person can sue for damages. Sovereign immunity will not <br />apply. Our streets are not just a nuisance, they are a lawsuit. Thank you very much. <br />Mr. Buckholtz stated to Mrs. Eisenberg that we take her comments quite seriously. Even <br />though we joke with Mrs. Eisenberg from time and again because she is here all of the time. We feel <br />we have a good relationship with Mrs. Eisenberg, but Mr. Buckholtz knows it was about a year ago <br />that she first raised the issue. Mr. Buckholtz will defer this to Mr. Metzung, but it has not been kept <br />off of any agenda. There is a plan to fix those streets. Mrs. Eisenberg added that Mrs. Mills told her <br />that it was not included in the budget. Mrs. Mills added that it was not put in the budget for this year, <br />but that does not mean it would not go into the budget for 2007. <br />Mr. Buckholtz indicated that the sewers had to be installed on Highland. Mr. Brett added <br />that if you tear up sewers, you have to do the roads. <br />Mrs. Eisenberg added that she hopes we make it through the winter and nothing happens. <br />She does not want to see anyone in the street and get hurt. No one wants that on their plate, nor does <br />she. Those streets are very dangerous. They cave in all of the time. She received a call on Sunday <br />and he said that there is a water problem where the street is falling apart right in front of his house <br />and he just put new grass in there. It is only a matter of time. <br />Mr. Buckholtz thanked Mrs. Eisenberg. <br />CONSIDERATION OF MINUTES <br />Special Council Meeting -September 11, 2006 <br />Mrs. Mills, seconded by Mrs. Cinco, made a motion to approve the minutes. <br />ROLL CALL: AYES: All <br />NAYS: None <br />Motion Carried <br />Minutes Approved <br />PRESENTATION BY SENATOR ERIC FINGERHUT REGARDING ISSUE 18 <br />Senator Fingerhut passed around packets containing information regarding Issue 18. <br />Senator Fingerhut thanked Council President Buckholtz for inviting him to spend a few minutes <br />to discuss Issue 18 which will be a county-wide initiative on the November 7th ballot. Issue 18, <br />if passed, would raise the tax on cigarettes in Cuyahoga County by one and a half cent per <br />cigarette or thirty cents a pack to raise approximately $20-25 million per year, the entire <br />proceeds of which will go to support the arts and culture activities in Cuyahoga County. <br /> <br />1 <br /> <br />
