Minutes of the Regular Meeting of Council <br />Monday, March 19, 2012 <br />Page 10 <br />Ordinance 2012-08 is titled as an access easement agreement for the Library property. <br />There are two easements described in this Ordinance. The second easement is really <br />another donation of property to the Library to accommodate a larger parking lot. At the <br />September 2010 Council Caucus, Sari Feldman, Executive Director of the Cuyahoga <br />County Public Library was asked why the library project funding did not include land <br />acquisitions. She replied that their operating budget had been reduced by 10 million dollars <br />and they had to reduce their capital expenditures accordingly. They were therefore looking <br />for more affordable means of accomplishing their projects. <br />I would contrast this to the Village's police station project where funding was limited and <br />the Village had to find a way to achieve our objectives within budget limitations. The <br />donation of Village assets and funding for a County project has been objectionable since <br />this project was first presented to Council at the September 2010 Caucus. These Village <br />commitments continue to grow The people in Mayfield Village should not have to support <br />this project with both our County and municipal taxes. <br />Mr. Delguyd thanked Mr. Marquardt for his comments. As the newest member of Council, <br />I did not vote in the earlier sessions and was not privy to a lot of the discussion. After <br />discussing with people on Council and Mrs.Wolgamuth and Mayor Rinker, in the grand <br />scheme of things, I do not have opposition to the Library. I don't have opposition to the <br />access road that we are being asked to build per se. The opposition I do have is that the <br />original plans, the reason the access road has grown in such cost is because the plans were <br />moved from the front part of the property on SOM significantly far back. The original <br />estimates we were given for the original access road was in the $50-75,000 range. We <br />were told that it was based on some preliminary drawings and when they changed, it was <br />then on the Village to incur the extra cost of the access road. In my opinion, that <br />additional extra cost above and beyond the $50-75,000 should really be on the County <br />Library because they are the ones that changed the preliminary plan. I don't know at this <br />point given where we are in terms of timing if we have an opportunity to go back and ask <br />them to pay the additional fees. I don't even know if that's plausible. I just wanted to give <br />out my thoughts, and concerns. - <br />I think from a future standpoint as we are entering into these agreements I understand these <br />are different governmental entities, different economic entities, things are fluid and, we <br />have to be flexible, but at the same time, we can't continue to vote on things and say that <br />there is preliminary approval and then when the plans come back and they are significantly <br />different, we just say go with it. I think we need to basically be more assertive in our <br />negotiations. That's just my thoughts. <br />Council President Buckholtz explained for the audience, we have been talking about this <br />extensively at meetings and how this evolved and what happened and how there's different <br />points of view on it. I would like to ask any Council members first if they have any <br />comments. If not, I would turn it over to our Law Department for comments. '
