Minutes of the Special Meeting of Council
Monday, June 4, 2012
Page 8
Council President Buckholtz asked, have you expressed this to Mr. Gatto? Mr. Gatto? The point
that Mr. Kinnaird just made, has he expressed that to you about trying to leave as many mature
trees there?
Mr. Gatto replied, we did. We actually talked about the one on the corner. We talked about how
the parking will go in there. There would be a large enough area there. It's not going to disturb
those roots. The southwest corner of your property, the large oak tree, we are going to work
around that tree and salvage that tree.
Mr. Kinnaird stated, it was something, I know a lot of times it makes more sense to go in and
clear everything. He has to make a way to get drainage in there. But, is there any way to keep
any of the trees here until phase two is up.
Mr. Gatto replied, depending on what we are going to be required to do for drainage along the
South property line, because that's where we have to work with the city on their screening
requirements. We talked about that. Depending on how that water is going to flow and how they
determine that and how we tie that in to the retention area, we will work on leaving trees in there.
I will work on leaving trees in there. I will work on leaving trees in this area right here and see if
we can't move around any type of detention or retention. We will use our best efforts.
Council President Buckholtz asked if there is a handshake. The gentlemen shook hands.
Ms. Calta asked, can I just note for the record that we will mark your appeal as withdrawn Mr.
Kinnaird? IVIr. Kinnaird replied, yes.

Ms. Calta replied, thank you. We have obviously heard all of your concerns and they will be
taken into consideration. Just one more note if I may. We have a Development Agreement in
the works is how I would describe it. So it is being developed, but certain conditions have
already been identified for inclusion into that report as detailed by the BZA Minutes and their
approval.
Council President Buckholtz thanked the individuals for showing up and working it out.
Council President Buckholtz asked if there were any other matters.
Mrs. Cinco wanted to note how the Code Red worked last Sunday. It was very interesting.
Chief Mohr replied, the weather alert went off. Those that had the paging system, it went off.
There was a thunderstorm.
