Minutes of the Regular Meeting of Council <br />Monday, September 21, 2015 <br />Page 4 <br />program. Leaf season will begin around October 19a' this year which is our typical third-Monday <br />of the month. <br />BUILDING = .~olin 1Vfiarrelli - - - - - - - - - - - - - - <br />Mr. Marrelli reported,- Governor's-.-Village expansion is completed as of today. They- will b_e -- _ _. <br />- --starting -to -fill--their rooms-up shortly. -Hopefully-some ofyou-have--been -able to-go take -a tour- __- - ---- <br />through there. The facility came out real nice. I am real proud of it. <br />ENGINEERING -Tom Cappello <br />There was no report. <br />LEGAL DEPARTMEIi~T -1VIr. Diemen <br />Mr. Diemert reported, the Clerk and several, if not all, Council members, received a letter from <br />the Fraternal Order of Police Lodge 57 relative to the Charter amendment pertaining to <br />candidacy for the Chief position in the event of a vacancy in Police or Fire. <br />The language Council adopted in that Ordinance was changed by the Board of Elections over our <br />objection. We called Brent Larkin from the Board of Elections. He had a totally different version <br />of this particular language that really would have been unrelated to the actual amendment the <br />Charter Review Commission proposed and this Council sent down to the Board of Elections. It's <br />important to note that Exhibit A to that Ordinance which ultimately went to the Board of <br />Elections, 2015-15, which is how the lower ranks are going to be participating and able to <br />compete for the Chiefls position, the actual amendment itself is exactly the same on the <br />amendment, so whatever the ballot language is, the amendment will be what Exhibit A is. <br />The goal of the Secretary of State's office and the Board of Elections and of course ourselves is <br />to try and make the language as reflective of the amendment itself without having the ballot issue <br />two pages long. The Secretary of State would not allow that either. We took our stab at it. <br />Council approved it. The Board of Elections said they wanted to change it. We went back and <br />forth with them and ultimately they came up as you can see from my handwritten notes we had a <br />lot of different changes that we went back and forth with the Board of Elections on and they <br />insisted on this language. We .could have appealed it to the Secretary of State but chose not to <br />because it did appear that it would have the same result because Exhibit A is not being changed. <br />I say that because the FOP is concerned that because they only have one Lieutenant, it will <br />automatically mean outsiders can be considered by the Civil Service Commission for <br />competition for the Chief s position. The Charter Review Commission's goal was to do just that. <br />They did not want patrol officers competing for the position of Chief in the event there was only <br />one Lieutenant, that's the result that would have occurred. It was the Charter Review <br />Commission's debated decision that if all that was left were patrol officers in order to get two <br />qualified and interested individuals, they wanted to go outside or give the Civil Service <br />Commission the option to go outside. In the event there are Sergeants, it would go to the <br />Sergeants level as well of the Police Department and if there are two or more in the Lieutenant or <br />
