Minutes of the Regular Meeting of Council <br />Monday, October 17, 2011 <br />Page 14 . <br />has to do what they need to do. The lot-split consolidation type of things are just part and <br />parcel to what the project is, but our function is just the Development Agreement itself. <br />Mayor Rinker stated, for everyone's benefit, the Development Agreement basically is <br />everything that has been represented to voters as to what the project is going to <br />accomplish. It is incorporated into this Development Agreement. If voters reject the <br />proposal, the Development Agreement goes away by itself, by operation. It would not be in <br />effect. But the idea, so voters understand that there are certain commitments being made <br />on how this site will be developed as far as where curb cuts go, setbacks, landscaping, <br />allowing certain control with the Village as to controlling these buffered areas in order to <br />ensure that the impact against adjacent residential areas is minimized. There will be final <br />site plan approvals if voters approve of the rezoning because typically the zoning changes <br />the zoning. It's not on a particular project. <br />Our Development Agreement is to outline the basic bones of this project so people know <br />that when they vote one way or the other, if people vote in favor of it, they know pretty <br />much what they are going to be getting subject to some minor details that you often find <br />when there are more detailed engineer drawings as to certain grades and other factors of <br />that nature. But in terms of the basic understanding of what the building will look like, how <br />the parking lot will be laid out, the spacing between residents and the development, all of <br />that is contained within the Development Agreement. So it's committing Deacon's and the <br />Village to make sure that voters understand that what they are going to vote for is what is <br />going to be delivered. <br />Council President Buckholtz stated, I would just add what I always add in these votes. <br />Basically what we are voting on is to send it to the ballot. We are not endorsing it. But in <br />support of what you are saying,. they have agreed, primarily in real simple terms, to <br />maintaining the residential feel and appearance of the area that was or is residential. Am I <br />correct in 'saying that if they come to P&Z or report their final plans, if anything isn't in <br />compliance, we don't have to go forward with it? <br />Mayor Rinker replied, that is correct. <br />Dr. Parker asked, the fact that we have a Development Agreement, is that not a statement <br />of endorsement? <br />Mayor Rinker replied, it's saying it's endorsing what the outcome will be if voters approve <br />it. <br />Council President Buckholtz replied, it's different than when we pass something along. <br />You're right, and I thought of it as I was saying it, it's different than when we just simply <br />pass something to the electorate. In this case, the Development Agreement as we see it, we <br />like, but it still remains to be seen the exact details getting hammered out and going <br />through the proper process the proper way.
