Regular Council Meeting Minutes <br />12-20-10 <br />Page 2 <br />Council President Buckholtz thanked Mrs. Eisenberg. We don't always engage in dialogue when you <br />have a comment, but of this nature, this came up at the special meeting that the Library held. For <br />members of the media and the audience, we may warit to discuss this. <br />Ms. Ca1ta replied, the question did come up at the Library meeting last Tuesday. The property is <br />zoned residential and as it goes back towards 271, it changes zoning and becomes office/laboratory <br />and then production/distribution. It's a layercake zoning over there. We haven't seen the Library <br />site plan, but it is thought that the residential portion will be where the Library is situated. Marge, <br />you are correct that under the U-6 there is a specific section that identifies a library which would <br />require a special use permit in residential. <br />Mr. Marrelli added, a conditional use pennit is not permitted in residential. A special use pennit is <br />allowed in any district. Those words are, you didn't read them, but they are in that section that you <br />just read. <br />Mrs. Eisenberg stated, but it is a mandatory U-6. <br />Mr. Marrelli replied, that's correct. <br />Mrs. Eisenberg stated, and a mandatory U-6 is a- <br />Ms. Ca1ta continued, Marge if I could just finish my thought. I don't want to interrupt you, but if you <br />will give me a moment. Under an R-1 district, however, any municipal use is pernutted in a <br />residential district. So having said that, Mr. Diemert is reviewing at this point whether it would <br />require a special use permit or the Library would be considered a municipal use. We will certainly <br />get you a copy of the legal opinion when it is completed. I don't know what the answer will be other <br />than to tell you no it does not require a change of zoning to be placed on the ballot. <br />Mrs. Eisenberg stated, yes it does. <br />Mr. Marrelli replied, no it doesn't. <br />Mr. Saponaro stated, this is not a dialogue. <br />Ms. Calta stated to Marge, I disagree with you. <br />Council President Buckholtz stated, right, I just wanted both opinions on the record at this point but <br />more information will follow. <br />Council President Buckholtz asked if there was anyone else who would like to address Council. <br />There was no further discussion.
