Regular Council Meeting <br />12/19/05 <br />Page 16 <br />people are going to have needs and expectations. The question is how bad of a risk is that. <br />Mayor Rinker does not see it as a bad risk, other people might have different thoughts. <br />Mr. Buckholtz indicated that it is another natural step in raising the level of technology that we <br />have. We were having a similar discussion during Mr. Brett's presentation. We talked about <br />this a year and a half ago and discovered that we did not even have an internal network. When <br />you read the specific addendums that come along with OneCleveland, where would they be <br />plugging that access point in to. We really did not have that, only something at the fire station. <br />We have now created a network and are raised up to the level of technology for the general <br />public. <br />Dr. Parker stated that it is kind of like with phones, certain aspects of our technology both in <br />businesses and at home have improved. There was a time everyone had rotary dial phones and <br />new services became available and over time the technology caught up, the cost of it caught up <br />and most everyone has a push button digital type phone. The same is going to happen with <br />this whereas it may be available and may not be utilized at this point but over time the <br />hardware will come about and the ability to use it will come about. It's just a matter of time. <br />Mr. Buckholtz indicated to Dr. Parker that what he said is very much on the money. He added <br />that when DSL first came out, he could not get it on his street. Other places could, but you had <br />to be within a certain number of feet or miles from the substation. Worton Park did not make <br />it. Parts like S.O.M. Center provided DSL. He had to wait a number of months later. Another <br />example would be cellular phones. If you lived in a community where suddenly your signal <br />just dropped off because you did not have a tower and suddenly you had the ability through a <br />public private partnership or some kind of a new organization providing people with cellular <br />service back when you had those drop offs, that would be good. This is more on that level. <br />Raising the level to something which has become a very popular item. Mr. Buckholtz does not <br />see downsides. The only questions he has is for the law department. <br />Mr. Diemert indicated that he has completed most of the research and is in the process of <br />putting it into writing order. They are checking with some of the other locations that have had <br />this. The service will be tantamount to the well-channeled status of the law concerning utilities <br />and governmental services. It will be considered a governmental service that we are providing. <br />It will not be a proprietary thing where you can have any liabilities. We have the protection of <br />complete immunity under the Ohio Revised Code and also under common law because it will <br />be considered a governmental service. There is no liability exposure to the Village. <br />Mr. Buckholtz added that the other issue the IT Committee can look at later with the law <br />department is if we want to post a disclaimer on the website. Mr. Diemert indicated that that is <br />the part he is still looking into. <br />Mr. Buckholtz asked Mr. Marquardt if Phillips has anything in writing or documentation on <br />how they treat wireless since it is restrictive. Is there something written out? Mr. Marquardt <br />indicated they do not. Mr. Brett pointed out that in one of the articles the Crystal Family <br />Restaurant is discussed. They hire a company that screens and posts a disclaimer. <br />
