Special Council Minutes <br />5/9/OS <br />Page 12 <br />be up and running in about a year. As part of the work over in this parking lot, you may recall we <br />were able to develop 2 soccer fields and with the S.O.M. construction we are looking to a 3'-d <br />soccer field positioned up approximately here. Those soccer fields have been very, very <br />successful and we would expect the same for this one. The overall scheme has allowed us to be <br />very, I think, very generous in the way we have mounded and landscaped all along the frontage <br />of S.O.M. on this west side in conjunction with median work that we have done and in <br />conjunction with the residential and the parklands that lie opposite. I just went up there today and <br />at the Gateway entrance (here), trees were planted (in the first stretch) so bit by bit as we see this <br />unfold, I think the total package demonstrates this is really very cohesive; it is well thought out <br />and it is a thoughtful plan. And at the end of the day, I think the wisdom of king of looking at <br />this kind of organic completion of the 1997 is something we can all be very proud of and I think <br />it will stand the test of time. <br />Council President Buckholtz said thank you, Mayor. We have a motion on the table. I would like <br />to open it for discussion. Does Council have any comments? <br />Mr. Marquardt asked, Mr. Diemert has just mentioned Progressive had been negotiating for some <br />time with Mr. Costanzo, what is it the Village is going to do here that is going to be more <br />effective than Progressive has been in negotiating these properties? <br />Mr. Diemert said as you know, between private entities they can only negotiate based on who <br />wants to sell and who wants to buy and there are no restrictions on what is fair or not fair. When <br />the Village gets involved, the power of eminent domain gives a semblance of order to <br />negotiations where your base is going to be what is the appraised value, what is the fair market <br />value. From that standpoint, then the property owner has to then become more reasonable <br />because if we are the entity that is willing to pay a fair market value for the property. Eventually <br />7 jurors of the peers of all of us will sit in judgment as to what is fair and what is not fair. At that <br />point in time, it forces folks to become more reasonable in their discussion as to what needs to be <br />paid. <br />Mr. Marquardt asked, does this Resolution authorize the use of eminent domain? <br />Mr. Diemert said no; this is declaring our intent to do so. It only, at this stage allows us to <br />negotiate with him with the appraised values which are fair market values. At this point in time <br />then they will at least see that the Village is willing to entertain that thought. You still would <br />have to pass another piece of legislation before it would be filed. <br />Mr. Marquardt asked, has Progressive agreed to pay for all costs associated with this type of..... <br />Mr. Diemert replied yes, they have. <br />Mr. Marquardt asked, and the negotiated price? <br />Mr. Diemert r.eplied yes.
