DRAFT <br />Council6/20/OS <br />Page 10 <br />• The Police Department, again, we took out some language which was no longer <br />applicable and in Article V, Section 8, said all part-time patrolmen are to be considered <br />employees at will. <br />Mayor Rinker asked how this differs from the language for the previous page, where you have <br />all temporary and part-time employees of the Municipality shall be in the unclassified service. <br />How does that distinguish from employees at will? <br />Mr. Hanculak clarified by stating there was a letter sent out to Council and the Mayor; it came <br />about as discussion because in the Ohio Revised Code, even though individuals may be <br />considered part-time within the police department, they have the ability to appeal their <br />suspension or their dismissal to Council; that causes a tremendous amount of problems for the <br />Chief with regards to scheduling those types of individuals used as fill-in. This gives the Chief <br />more flexibility to do that. <br />Mayor Rinker said he doesn't dispute that but he is trying to understand how that differs from <br />every other department. <br />Mr. Hanculak stated there is a specific statute that applies only to the Police Department, which <br />would not apply to members of the Service Department. <br />Mayor Rinker said it is then necessary, because of the Statute. <br />Mr. Brett wanted to know if there was a difference between unclassified and serving at will. <br />Mr. Hanculak said yes. Mr. Hanculak stated there is a State Statute which mandates police <br />officers, no matter what, full or part time, are not employees at will, but are unclassified. Mr. <br />Hanculak stated this will supercede the Court rulings. <br />Mayor Rinker asked if this was the same for the Fire Department. <br />Mr. Hanculak said yes. <br />• Mr. Caticchio said that deals with the next section, Article V, Section 9; all part-time <br />members of the Fire Department are to be considered employees at will. <br />Article V, Section 9.1 Regionalized Districts. Up to now, the Council, it says in any <br />event, Council determined that it is in the best interest of the Municipality to join or <br />participate in a regionalized public service, that Council has the authority to join. The <br />Commission raised a question amongst ourselves because they had several discussions <br />about the police and fire department being regionalized. We didn't think that that was a <br />good idea and we don't think that the people of the Village would vote for something like <br />this.
