Regular Council Meeting <br />4-16-01 <br />Page 4 <br />DEPARTMENT IIEEAD REPORTS <br />S.O.M. Center Road Wideniniz Committee - Mr. Ilacqua said there is no report. <br />OLD BUSINESS <br />Mr. Ilacqua said he would like to add to the agenda if Mr. McGill wishes to discuss his position <br />to Council to vote to overtum the ruling by the Board of Appeals. It would take an affuinative <br />vote of 5 members of Council to overtum the ruling. As there are only 5 of us here (with 2 <br />absent) if you discuss it this evening and present it to us, it would then take a unanimous vote by <br />all 5 of us to overtum it. So, I wanted to be on the record and give you the option-if you wish <br />to bring this before Council at our next formal meetuig (perhaps a117 of us will be here) and that <br />might be the way tQ. go_. When we_head.into, the.OPENPORTZON ifyouu.wish to pr,esent it to <br />Council, that is at your discretion. <br />Mr. McGill saio-so then we would just go to the next meetuig. <br />Mr. Ilacqua said yes, if you didn't discuss it this evening before Council. <br />Dr. Parker asked if there are any time constranits as to when he must present this to us. <br />Mr. Samac said.the- time constraints were met as far as N1r. McGill sending in his notice of <br />appeal to Council. Now that we are here and the issue is on the agenda, Council can hear it. <br />Typically, if the Board of Appeals and Council have less than a full body, we give the applicant <br />the option of postponing until"the next meeting. 'I`liis is pr`unaxily as a courtesy because with a <br />CQUncii of fiYe hexe toni? itwould take a115 members to vote.in the_affirmativa to overturn, <br />the decision of the Board of Appeals. With 7 members it would still just take 5. If everyone <br />does not agree to overtum tonight, then it would be defeated and that would be the end of your <br />appeal process. If you want to wait until next montlh when there are'7 members here, you wEl <br />still need 5 of Xhe 7 to vote affirmatively to overtum the recommendation of the Board of <br />Appeals but thatis S.to Z instead.of 5.tfl.5_ <br />Mr. McGill said he may as well present it now since there may not be all 7 present at the next <br />meeting either. <br />Mr. Samac saio it is unusual that we have as many people absent as we do including Department <br />Heads.
