Memo re Request for Special Use Permit <br />at 731 Beta from Mayor Rinker 4-12-00 <br />Page 5 <br />Accordingly, just as each of these other municipalities has contemplated unique <br />demands and needs, so, too, Mayfield Village has its own fingerprint and personality. <br />" Since Beta Drive is literally at the heart of the Village, we would do well to improve our <br />insight and understanding of how it factors into the scheme of things. <br />Overall, I suggest that this process of evaluation take place over the nex# 6 <br />months to a year and a half. If we go about it methodically and objectively enough, we <br />should be in a better position to see whether or not any ordinances need be adjusted. <br />Even assuming none are adjusted, simply by worlcing on the subject we will in this <br />process develop a current and thus more viable body of evidence to support our <br />Plaruung and Zoning scheme. <br />Step Three. Long-term Consideration of the Beta Conunercial Zoning Mix <br />Finally, I also believe that a by-product of the type of comprehensive evaluation I <br />suggest we initiate above will further lead us to a point of seeing whether or not any <br />adjustrnent of the zoning use mix witliin the Beta complex is called for. This long-term <br />aspect of the evaluative process would sunilarly serve either to reaffirm the status quo, <br />or point the way toward an amendment to it. I believe this process would underscore <br />one of the principles of rezoning through referendum vote: that an informed electorate <br />is ideally positioned to decide upon such a significant matter as rezoning. If the <br />? question is posed to the electorate as a consequence of good inforination-gafihering, then <br />such a ballot proposal makes sense. On the other hand, ff the uiformation-gatheruig <br />v^ ::ates the existing zoning scheme, the result is not simply that we have kept the <br />zoning intact, but that we will know by any objective measurement that the zoning . <br />scheme remains the best suited for the Village. That is an enviable position in which a <br />municipaliiy places itself in fending off any challenges to the zoning because its has an <br />up-to-date body of competent evidence on which to rely. <br /> <br />In the last analysis, I believe that it is prudent to resist presuYning that issues of <br />Planning and Zoning are static. There is a great temptation in stating, "If it ain't broke, <br />don't fix it." when facing zoning issues. Legal challenges to zoning typically prevail <br />where the passage of time has advanced to the point that what made sense at the time <br />of the enactrnent of zoning may no longer make sense, because things have changed, <br />there has been a shift in the balance of things. It is not enough to assert that we sunply <br />like things as they are. CircuYnstance often dictates that we must continuously prove <br />why things should remain as they are. If we go about the evaluative process correctly, <br />we make those amendments only to the extent they truly serve the best interests of the <br />community, and only after we have collected good inforrnation and evaluated it <br />methodically. At the same time, we demonstrate why other things can remain the same <br />in the current context.
