Regular Council Meeting
4-17-00
Page 15

Mayor Rinker said the standard is that Council reviews any continuation of this particular
usage reasonably but concludes that it will be inappropriate. I think we would have to live
with that decision. At least it gives a safety valve to the Village that the parking lot would
not determine the long-term usage. He also asked if they amortize this type of
unprovement.
Mr. Rapaszky said we are only asking for a Special Use Pexmit for a medial office. It has
not been rezoned so we would have to apply for a Special Use Pexmit. Mr. Rapaszky said
they amortize the improvement over a 10-year period. The rent would be close to $25 per
square foot. That [special use permit] is a good club you have over us.
Mr. Buckholtz asked if the parlcing could be built and still leave 60' setback from the
sidewalk and still be landscaped right. (Instead of 57.3)
Mr. Rapaszky said he must look because they were looking at the angle; he would have to
ask.
Mr. Samac said that may become another conflict to our code. It is best to have that 20'.
Council President Marquardt said I have considered everything that has been said here. I
think our Charter and our zoning codes have served this Village very well as far as
maintaining the quality of life and servicing a commercial community. I look at this
package as, in my mind, as skirting the referendum zoning. We are in essence changing
the zoning from Warehouse/Distribution to Office/Laboratory. With the Special Use
Permit and variances we are looking at here, I cannot in good conscience support. That is
my position. He asked for a roll call.
ROLL CALL: AYES: Mr. Buckholtz, Mrs. Cinco, Mrs. Mills, Dr. Parker
NAYS: Mr. Susa, Mr. Ilacqua, Mr. Marquardt
Motion Carried
Special Use Permit Granted
?
?
LJ
A motion to approve a Front Yard Setback Variance for 731 Beta Drive (Panzica
Realty, Inc.)
Mrs. Cinco, seconded by Mrs. Mills, made a motion to approve a Front Yard Setback
Variance for 731 Beta Drive (Panzica Realty, Inc.)
